I sent a CPR 18 to Kearns solicitors and have sent me loads of docs that Were asked for in the CPR 18. They are asking me to send in a doc admitting the debt to the claimant IDR Finance UK II Ltd. Who is the claimant? Who are they?

The original debt was with Barclaycard then assigned to Link Financial then assigned to IDR Fianace. Whats going on here?

Have they started proceedings, if so the claimant will be named on the Particulars of Claim.

IDR & Link are part of an asset management group called CapitalFudiciary, IDR work under a service agreement with Link.

Well the list of documents they've sent you appears fairly comprehensive.

What you'll need to do is examine the agreement to see if it contains all the prescribed terms.

If they have me bang to writes then what? They sent me a form to admit the claim, put a monthly instalment forward and also consent a judgement made against me.

Can you post up a copy of the form you've received?

It really is up to you to assess what they've sent you.

There is a way of avoiding a CCJ (if you can't risk getting one) by agreeing to what's known as a Tomlin Order, but you will have to agree a repayment plan and stick to it..

If you're not bothered about getting a CCJ, then you could risk turning up a Court to see if they do, they may, they may not. If they do, by experience I suspect they will get their Order.

I have just offered £1 a month and the solicitors agreed as long as I sign a Tomlin Order. Whats the catch?

The 'catch' if you like is that a Tomlin Order halts (stays) proceedings, if you fail to keep to the order they can request proceedings continue to a full hearing, otherwise it's binding on both parties, so whilst it's in place they can't go for a full CCJ.

So that means for a debt of say £5000 it will take 416 years to pay off. Why would they accept that?

In their view something is better than nothing !! They get a few 100,000's paying a £1 a month !!

They are still out of pocket. Say they pay 10% of 5000 = 500. 1 a month = 41 years that's still a long time to break even especially when you could be in your 40's or 50's and dead before its all paid. Then again I was never good at maths lol
