Hello and hoping I can get some help re a notice from a debt collector who states they have been passed the outstanding account for them to collect on behalf of their client. The water company concerned I have not heard from in over 2 years as they never responded to letters I'd written about the safety of their drinking water. Then out of the blue I received a bill from them for over 500 quid and so I put it back in the envelope addressed it ANRRTS and opened in error and that was last week. Today I got a letter from the debt collector claiming £609.91 a lot more than the original bill from affinity! Would this be a case to use the 3 letter process to deal with a third party interloper or are there other ways to approach it? Thank you in advance and would appreciate a reply ASAP as they have given 5 days to reply and that is dated from the 7th of this month. I know they use scare tactics but I had 'bailiffs' knocking at my door out of the blue in July with a dodgy warrant as I checked its authenticity and there is no record at any court of a warrant being issued against me. Any way they extorted nearly £1100 from me, with the aid of the police, on behalf of edf when I was in the process of demanding answers from them over the bills and how it can be paid through the bills of exchange and I don't want to go through that again and I cannot afford to pay out anymore as I'm on benefits. I have paid & am in correspondence with water company. I paid by endorsement around April 2017. So far have not had DCA(s) knocking but as have firmly told water Co the account is now indispute & if they want to go to court I CAN prove payment was done through bills of exchange - so far thier response has been very weak with NO effort on thier part to prove anything. So carrying on as is for now!

Notice in Writing

I am in receipt of your letter dated xxxxxxxx The contents of which I rebut and reject
in their entirety . We have no contract or agreement of any kind.
I do not recognise you or your corporation.
Any money I may lawfully owe xxxxxx will be paid to xxxxxxx and under no circumstances
will any money be paid to you.
This is my only response and no further correspondence will be entered into.
Any further contacts will be recorded and logged and considered as harassment
and I may take action under section 1 of the Protection from Harassment Act 1997
I trust this makes my position clear.

Thanks dave that sounds straight to the point, I like it and makes sense but does it work and has any one else tried it. I do get the gist of what you are saying as they are a third party and I have no dealings at all with them but the last lot I had no dealings with still went behind my back and apparently went to court( there is no record of this) to gain a 'warrant' and with the aid of the police extracted money's with menaces from me!

The good news is they can't disconnect you, the bad news is they are increasingly going to the County Court for CCJ's, then using bailiffs and attachment of earnings orders or payments from benefits to enforce the orders.

It appears Tiggy you are right but what can anyone do about it? In my case with edf I was never aware of a summons and it was obviously a private court and I did not consent to going to it as I didn't know. It appears justice is taking a back seat in courts!
and Dave you are spot on but I need my contempt for them to turn into results!! ;0)

Water's a difficult one, especially as you've used the water, with the majority of it being washing (shower / bath / washing machine) and toilet, so the water quality defence won't cut it I'm afraid, especially if they can prove they conform to the Water Quality Act.

As they're only agents, so they shouldn't worry you too much.

maybe i should bill them for collecting rainwater in my gutters and feeding it into their system through the downpipes as well as supplying them with manure and ammonia solution? lol

Just a quick question, I am not too sure what you are saying about "how it can be paid through the bills of exchange", did you actually pay by endorsement?

I did pay (edf) by endorsement yes but they refused it saying they don't accept payment by stamps!!

have told all DCA(s) will only deal utility Co's & will only pay utility Co's NOT them - still get demands but most of the time NOT signed by anyone. Gas & leccy seem to have gone off a bit - quiet but this is must be the calm before the storm.

That's where i'm at & nothing else to say at the mo!

If you are benefits look into the big difference scheme here This is the scheme for Severn Trent water, but I think all water suppliers have one. All you have to do is show you don't have much left at the end of the month to qualify and you can count the cost of smoking and tv licence and internet and other bills, but be realistic. Don't make it look like you spend 100 quid a week if you only get 60 quid. The 3 people I know who claim this pay £3.84 a month and one of them got the arrears wiped out but the other 2 pay a little extra off the arrears they have.

Trango,

Would it be worth asking water Co for another "bill" & this time pay by endorsement? That way you could at least if it went to court you could say "look its paid, here's the evidence" (scanned copy of payment document).

thats an idea LionsShare but I’ve been sending their letters back as ANRRTS so it would look odd i feel..and it didn’t work out well trying endorsement on edf as they ignored it even though it was a lawful payment!

don't worry to much how things would look. As you would be attempting to pay that's the most important thing to them. Watch those vids I posted earlier & see if you did something wrong & obviously do it correctly.

As you say you are on hard times money wise so try to turn things to your advantage. ANRRTS does not work in the long term as others have found out to thier cost. Me, I have always replied to ? getting them to prove what ever they claim, demand they STAY in honour (I know that's wishful thinking).

Something I have started to do is emphasize "Implied admission absent a response & compliance creates legal record." In short if they don't reply in substance to YOUR demands/questions they essentially admit to it. Also "This legal notice adds to the record of the parties." - To me this is 1 of the most important. State by showing to date this is what has gone on -"I can show its been paid, show where you claim (water Co) its not been paid remedy has been offered" etc. This will depend on what you put in this yourself.

Regarding the ignored lawful payment I know as am getting that myself.

All I can say is good luck & I sort of know what you may be going through - certainly regarding this.

water is a neccesity of life.
their is NO...contractual obligation...to pay.

unless you VOTE...
or.....give a shit about credit ratings.

I have not been mugged by...`ANGLIAN WATER`

for three years.
THIS is what i did.
received a notice from n.c.c.b.c.
returned it ``FOR FRAUD`
had a visit from a debt collector of whom i asked.
CAN YOU READ.
if so go and read the lawful notice you just walked
past......R.O.I.R.O.A
he left rather quickly.

Of course, i get the annual threats from different..D.C.A`s
have lost count of the companies who have tried their luck.

I never waste....ANY...time on them...ie.writing/speaking to
this criminal underclass.

their latest claim aprox....£3000.
two weeks ago.
this is what i do,YOU` do what you feel comfatable with.

I have a permanent R.O.I.R.O.A affixed to the entrance
of the property.
I return any threatograms.
if they phone...i block their number.
THEY IS FOOKED...
Of course, you will hear..you must pay..IT`S THE LAW.
err..it`s not the law, in fact...it`s...policy
a plan of action adopted or pursued by an individual, government, party, business, etc.
