NOTICE OF REJECTION OF INVALID INVOICE


Reference: Your NOTICE TO PAY FIXED PENALTY CHARGE XXXXXXX dated dd/mm/yy.

This is a legal Notice, it means what it says. Notice to agent is Notice to Principal and vice-versa.

THIS IS DEFINITELY NOT AN APPEAL.

This NOTICE is a conditional offer from me to settle the matter.

It is my understanding that fines can only be issued by a Court of Record, and then only after due process.

A Notice of Charge is subject to the Bills of Exchange Act 1882.

I require a properly formatted invoice, fully compliant with the Bills of Exchange Act 1882, for your charge or demand or order which is required to be legible and to include the following features:

Your company name, number and trading address.

The date of the invoice and the date by which the invoice is to be paid.

A full description of the goods and/or services supplied or provided and the cost thereof i.e. what of value has been exchanged? (The CONSIDERATION).

Account for VAT, be it zero percent or otherwise, and show your company's VAT registration number. If you are exempt from VAT, state it clearly on the invoice. I need to account for VAT.

It must be titled 'Invoice' and bear a legible wet ink signature of an Officer of the Company.


Do not send any further mailings which do not contain proper invoices, as in that event you will be causing me harassment, and you may also be committing VAT fraud.

In addition to that I would encourage people to also print copies off, I do this along with other useful information (when & where possible) that way any problems online & so on you have in black & white!

Here`s what you do.....if you wish.

Insert a couple of negative averments within the above
notice.

NEGATIVE AVERMENT
eg.
There is no evidence to suggest that the demands
made and, the protocols used within your NOTICE
are not fraudulent.

There is no evidence to suggest that you have not/are
committing mail fraud by not following the guidance
found within the bills of exchange act 1882.

I came across this link a couple of weeks ago, but because of illness, yet again, I haven't been able to post it. It concerns Council Tax and where this tax is going. Very interesting stuff,be interesting to see where this leads & responses given.
Now i am retired i have arranged my finances ,& do not pay CT any longer so not much point in doing it myself.

As per Daveiron sorry to hear you have been unwell & hope all gets better for you soon.

Agree it will be interesting to see where this goes. Perhaps the result is finding funding goes to something in the US (who knows - stating the obvious)?

Will seriously give this some thought to try to find what the local council says.

I would use it for that as stated in the information they are not 'fines' as only a court can issue such - they are 'charges' & as such are subjuect to VAT.

Another gem from Windows on the World.

Would someone be able to guide me in the direction of equivalent legislation to the Bills of Exchange Act or something akin to VAT in the United States? My research into the UCC is yet to yield the right to ask for a valid invoice. Were I in Canada, everything would be clear, but I'm having trouble finding analogs of your acts.

Much appreciated as this theme is ever more relevant.

They are likely to respond to your Notices with scary-looking pseudo-legal letter.

OR in the meantime, you could require Mr sqiggle to re-send his/her letter in
the form of a statement of truth.[affidafit].signed under their
full commercial liability.

DO NOT FORGET.As far as a court is concerned

Hi All, I withdrew my consent from paying council tax 2 months ago. Received an invoice for payment 1 month ago, returned with No Contract. Not heard anything for 4 weeks. Keep you updated.
