My mum passed away a few months back and I am now taking care of my fathers affairs. The legal process in dealing with my mums 'deregister' from the legal system has been an eye opener to say the least (I will tell more on that at a later date - a huge learning curve for me). I have now come across my mum and dad's 30's birth and marraige certificates and I see no ALL CAPS with regards to surnames. In fact my mum's has a one penny stamp on bottom right signed through by the registrar. So food for thought thier.
I have also come across deeds for the property purchase (where my mum and dad had bought their house) and a search of land ownwership dating back to the 40's on A3 size paper (ABSTRACT OF THE TITLE). I'm going through it trying to get my head round it. One thing that first caught my eye was the farm and farmland was sold and on the search for land ownership which shows the company (contractor) who bought from the farmer is an incorporated limited business which was given a 'Certificate of Incorporation on change of name had by special resolution and with approval of the secretary of state.' BY OFFICIAL CERTE OF SEARCH.
Then a building contractor became the mortgagor with a certain bank Barclays and I know for a fact that this mortgagor became bankrupt 3 times on land purchases in my area.
I have conveyance papers that were seal (the common seal of) and signed and sealed by said mortgagor to the new plot owners who also took out mortgages for their plots. This is on bonded crown paper. Pages long and in my opinion very interesting.
The certificate of incorporation was given in 1979 and sold on to said private contractor roughly 2 years later.
I need to get my head round this so TBC
In the meantime if any thoughts crop up please post. It may just keep me going.

I purchased land in CASH and registered it in our name.
I have a tight and close eye on to whom it remains before, in 20 years, I gift it for a quid to my offspring.!

Land reg.
I understand that there are two land reg. We did what was required of us by the conditions of sale.
It currently IS in our name.

From what I read, at the time of purchase, the new owners names are not placed in the reg. Its a bank or other name. So, if this is not changed at a later time, the same details remain.
I am to get a deed made up too. And as long as my details remain in upper or lower case, I can fight that. Mostly because I will be there in er...person to make the change to my sons name! Its after death that problems arise because those w@nkers are NOT to be trusted! And I know their home address...always a good thing!

Stamp duty on agreements was abolished some time in the 1960s I think. Before then an agreement couldn't be enforced unless it was stamped. Of course we still have stamp duty on property conveyances and large stocks and shares transactions, but apart from that I think it's dead.

a question along the same lines: so when you finish paying your mortgage off does one ever receive the deed from the land registry/solicitors in your name?
As I've a friend who finished paying theirs but all that has happened is that their payments have just stopped, I feel they should get some ownership docs at least.

Deeds are just historical documents these days and have no bearing on whether you own the land or not. You do get them from the bank or whoever held the mortgage, but I had to request mine from them. The land Registry sent me a certificate (like a log book really that you get with a car).

Thanks everyone good info and thanks iamani. I think I might start a new thread on the deregistring process and the will process that went with it. Better do it soon as its been 3 months now and my memory is not as good as it used to be.
I'm gonna keep looking into this land registry. I'm going to try and find out if these old farms were registered as well and at what point did the land registry start. Perhaps it even goes back to monasteries and the sale of land back in the old days. Anyway early days with my study of this subject but its a subject I like to get my teeth into because of my story above and how it effected me when my mum passed away and how when my dad goes I'm left holding a property for probate. When I got the deeds to my house, included with them was the deeds to 50 odd acres of land a few miles away from where I live. The Council built a housing estate on it in 1972, I wish the holder of the deeds was still the real owner, I would be quids now if they were. I think the Council land grabbed it under adverse possession rules but not to sure.

It would be a good Idea to Look into this quick, the land registry office has been sold off, and I remember a few cases where banks were having trouble because they couldnt Monkey with the record.
NOW , they probably will be able too.
