ccj bailiff letter
just recived a letter from courts notice of warrant of control saying to pay an amount by a certain date or a warrant will be issued for the removal of goods etc does that mean i will have to send a n245 form to the court asking them to lower the amount that i can afford to pay. or is there something else that can b done

Re: ccj bailiff letter
When you received the documents from the Court what did you do with them, did you defend against the claim or have they got a Judgment by Default?

Re: ccj bailiff letter
Sounds like a Judgement by Default because they didn't respond to the County Court claim pack.cdcrossy wrote:its my partner i dont think she even looked to be honest just i seen this letter and thought wtf and opened it
So, a few options, either apply to get the Judgement set aside and defend properly. They would have to explain why they ignored the claim forms and submit a defence. This has to be done straight away or the Court won't grant it. Costs £255 or free if on benefits/ low income.
Apply for a variation order using N245 and offer a repayment plan, costs £50 or free if on benefits or low income.
Pay the whole amount within 28 days of the order and it gets removed from the register of judgements, might already to too late for that though.
Offer a repayment plan direct to the claimant.

Never a good idea to ignore Court docs, you can defend (or choose to settle out of court if you should wish), ignoring them just makes matters 10 times worse.cdcrossy wrote:thanks guys my partner is going crazy
