12 Abolition of contractual restrictions on keeping hens and rabbits.

(1)Notwithstanding any provision to the contrary in any lease or tenancy or in any covenant, contract or undertaking relating to the use to be made of any land, it shall be lawful for the occupier of any land to keep, otherwise than by way of trade or business, hens or rabbits in any place on the land and to erect or place and maintain such buildings or structures on the land as reasonably necessary for that purpose:
Provided that nothing in this subsection shall authorise any hens or rabbits to be kept in such a place or in such a manner as to be prejudicial to health or a nuisance or affect the operation of any enactment.

Could I use this as an excuse to build say a large double garage to keep equipment in for keeping hens on land I would own. I would just do what I want to anyway and I am very mindful not to upset neighbours, but sometimes you will always get the nosy one who wants to butt in and make things difficult for you, usually because of jealousy.

Ok I suppose it means chicken coops and things like that. I would just have to hope no one complains then. The place is very secluded but it is in the middle of houses.

knowing some of the people on my allotment i would expect some complaint about a large brick building. There is further legislation about the use of space allowed, you should look for loopholes there if there are any .
regarding hens they do need a good reason not to allow it now.

No. it means you can erect chicken sheds and pens to house your livestock, you can also construct a building or buildings to support this activity and these would be a hay store, a shed for food storage, and possibly a third shed for tools and supplies such as fencing meshes, posts, staples, nails, and screws; along with the tools to install them such as spades, hammers, screwdrivers, and any other tool required.

There will always be a covenant stating what types of buildings you can erect and the most common one is that it must be classed as a temporary structure which can be easily removed, put up a barn and it becomes an agricultural building and NOT a domestic building, and yes there is a difference, and any new barn will have to be kitemarked and EU approved so you cannot build your own now.

That sounds a bit more promising. There are no restrictions on this land really, not any that could affect what I want to do with it. I would most probably get planning permission for what I want if I apply but how can you try and get off grid when you have to ask permission to take a pee.

If you have the land and you make a living from it, and this doesn't mean selling produce, it also means feeding yourself and your family, then you can go down the route of having a covenant to live on the land, this is an option to explore as while it is more complex administravily, it is easier to get planning permission.

That sounds promising, it's something I will be looking into if I manage to put my plans into practice. I did get a place out in Bulgaria a good few years ago, but just before I was going to go over I got ill and that sort of scared me to go. It's been about 5 years now since I finished treatment so I want to try again but nearer home in case I relapse, even though I deal with things on my own I wouldn't want to be on the other side of the World alone. At least here I have family and friends if things go wrong even though I'm not a people person but sometimes you do need someone you trust around you.
