URGENT: Civil Procedures Rules

Post by mumof3 on Mon Feb 05, 2018 10:04 am

Any one can help me with the Civil procedure rules, please?

I need to know the order i follow.

This an urgent request because, its a week gone by since judgement has been set aside
and if i remember correctly, there is a limited time frame for each step.

Can someone either list me the order of the rules For example do I start with CPR 33, CPR 13 and so on?

I know they were on the last GOODF but where to find them now, i would not know where to start.

Cheers

If the value is below £10k then send a CPR 18 request for further information, if above £10k then a CPR 31.14 Disclosure of Documentation.

Also, send a request for a copy of the agreement, but the most important thing is just to make sure you send in and serve your defence by the date set by the Court.

Hi Tiggy,

Thanks.  I am only  a bit unsure as this is the first time i have been at this point so want to make sure I am doing this correct, so it doesn't go against me.

ONE question, if you could help?

I do not need any further info from them. Not even the CCA.
This is because of the following:

  • First letter sent to me dated in 2011  - Over 6 years ago.
According to FCA, they are not authorised to collect debt since 2016
And in the letter they sent to court they admitted not being able to
obtain NOA, contradicting an earlier letter from last year.
    Breach of DATA Protection.

According to CPA rules,as understood,  do i HAVE to ask for further documents?

( i really do not feel i need any thing from them)

D

OK, you say 'first letter sent to you in 2011 - who sent the letter to you? What did it say?

Do you have you a copy of the Default Notice issued by your original creditor, that's the key to a statute barred defence, it's 6 years from when the default notice was issued - contact the original creditor, ask for the date it was issued and ask them to send a copy.

Write your SB defence, copy to the Court and Claimant and invite them to discontinue their claim against you.
