Would anyone please tell what to do when one receive threatening letter from National Compliance and Enforcement Service Historic Debt Team  for the alleged debt from 2010 for the amount of £1.70 for unpaid train ticket that amounted to almost £900. Actually, someone used, stolen, my brother ID details. He  does not recognise anything they described in their letter that apply to him. Now,  he have to go to the court to prove it was not him  but someone stolen his name/ identity. In the letter it says the person who  didn't pay the train ticket didn't have any ID so they do not have any other information besides the (false) name i.e. my brother stolen  name . When we look at the 3 letters regarding debts we notice that we are ask for foundation documents to prove their claim.

Perhaps you might like to take some time and see how these letters can be adapted to suit for your situation and put it upon them to prove their claim with documentary evidence which includes original copies of documents they are relying on to prove their case.

One of the things I would interested in doing in your situation would be requesting that they prove you were sent the notices they claim they sent you. It may well be that the cant and you may be able to get the case dismissed on the ground that if they cannot produce proof of claim then they have no standing in the eyes of the law. No standing = no case.

We all know they are trying to reverse the burden of proof, the right to not self incriminate and the right to silence. The infringement system is the tool for doing this.

Despite this, if it were, me I would still demand they prove their claim and that they have followed due process in the implementation of the law.
