ok no PPI , are you positive on that ? have you seen statements ?

the reason i ask is: helping someone now who said the same thing over and over, turns out when he found statements there was PPI being taken each month, he has just been offered almost a £1000.

also i would send a CPR31 request for documents

and a part 18 request for specific details on any default.

sorry to bombard you, but serious stuff now.

a cpr 31 request needs to something like this:

Please treat this as my request made under CPR31for the disclosure and production of a verified and legible copy of the following documents.

1) Any agreement/ contract along with terms and conditions from inception and any subsequent changes made.
2) Any default notice
3) Statement of account showing how this sum has become due.
4) A copy of any notice of assignment sent by the original creditor stating that this account had been sold to cabot credit management
5) The deed of assignment between the original creditor and cabot giving cabot lawful ownership of any account


You should ensure compliance with your CPR duties and ensure that the documents I have requested are copied to and received by me within 7 days of receiving this letter. Your CPR duties extend to making a reasonable and proportionate search for the originals of the documents I have requested, the better for you to be able to verify the authenticity and to provide me with a legible copy. Further, where I have requested a copy of the document, the original of which is now in possession of another person, you will have a right to possession of that document.

I look forward to hearing from you.

I see they have sent you a copy of what they call the agreement ? did they send any other papers with this 'agreement' such as the terms and conditions ? and does it contain your signature ?

but it is important you understand their move and motive for this decision, i assume they have written to you regarding this ?

what does the letter actually say ? because they have issued a claim now and it is with the courts then they cant just stop the claim, it is likely that they have decided they are not going to proceed with the claim, therefore it will become stayed.

but in order for this to end you will need an official letter of discontinuance.

important you know your position on this.

For what it's worth i had ignored a DCA until the court papers were received - with lots of help in here i followed the steps to defence...this is the matter:

Now another solicitor who deals with these kinds of defence has got involved and sent two letters (i have ignored and shall until court gets involved - if they can again?), my thinking is that had i given them more time might they have wisened up sooner!
