does anyone know if your employer has legal right to ask the police more information on a employee a background check without the consent or signature of the individual? Will they just supply the details of court orders and convictions if they do? Or whole story.

its vague check someone’s criminal record what does the mean the full court files, police records or just what you have access to on the DBS certificate?

There used to be known (may still be) a full disclosure or partial disclosure. If you are working in certain roles e.g. with children then it would be a full disclosure. If you were burger flipping then it would be a partial (if at all).

You then also have what is known (or used to be) as spent convictions.

But as far as I am aware you need to give permission for any check to take place.

It used to be a CRB check it is now a DBS check see here for some more info : https://www.gov.uk/government/organisations/disclosure-and-barring-service

This put my mind to rest a bit.

Types of check

There are 3 types of check you can carry out as an organisation:

a standard check shows spent and unspent convictions, cautions, reprimands and final warnings
an enhanced check shows the same as a standard check plus any information held by local police that’s considered relevant to the role
an enhanced check with barred lists shows the same as an enhanced check plus whether the applicant is on the list of people barred from doing the role
