Lowell Providing "statement" as proof for alleged debt

Post by stormy121 on Wed May 23, 2018 6:57 pm

So this is an interesting one, someone got a contract out in my name, it clearly isnt me as i actally have my own number etc that i used, they also used a fake email etc to aquire this debt, when i spoke with the police i was told nothing could be done as it was untraceable. Okay whatever i thought

Fast forward to now and lowell are chasing me for a alledged debt.

Ive started the 3 letter process and they have provided "statements" for proof that i owe this debt, take a look at this letter they sent with it,

Shall i just ignore and continue or something else i should be aware off? Cheers

Continue the 3 letter process and contiue in that line with everything you write to them.

If the dont provide the 3 foundation documents required to prove their claim then you know they cannot do you any harm in court.

Tiggy has said many times without the 3 foundation documents they have no proof of claim.

If they go to court you will include copies of all your letters to them in your defence package you send in to the court. In your defence statement say you would want their claim struck out because they have no standing in the court because they cannot provide proof of claim.

Say in that defence that if the court does not throw the action out then you will be of the view that the court has erred in law and that you may have grounds for an appeal to the next higher court. This puts a bit of pressue on the mag to their job.
