Hi all I have had success myself with the old forum so well aware it works .
I have a friend I am trying to help who due to relationship break up she has 2 debt totaling over £25,000 and is in a real state and I,m not surprised .
the problem is she has been paying each at a poultry amount but now they have sent out the current expenditure forms and we know where that leads.
I can,t remember whether their is a way out once you have started paying ..
any help much appreciated Wink

there is always a possible way out,

did your friend set up these £1 per month payments directly or was it set up through a DMP or through the CAB or something similar.

are these debts regulated by the CCA ? loan credit card etc or are they for an overdraft or something else.

Is there a clause in the agreement about changes in circumstances.

Perhaps post the agreement and we may be able to suggest or draft a suitable response as a solution.

Adding quotes from relevant laws would be helpful for myself

Hi guys thankyou for your replys she,s currently in hospital so I cant ask her anything relating to this but will when she comes out ..
ive managed to get PRA from taking action and they have admitted the £13,000 plus debt they have their mits on is not enforceable .
im now going to try to stop them from contacting her ...
looking on here LINK financial who has the other 2 debts dont look as easy ...

Keep your wits about you on the PRA one, it is a lot of money, and although they are saying it is unenforceable you can rest assured they will be finding a way to make it enforceable ( in their world ) so just be ready.

Link financial, like many others can be seen off with the right questions.

what makes you think they dont look easy ?

regarding PRA i would let sleeping dogs lie but just keep your paperwork together and be ready.

seriously any of these can be beaten even though she has been paying, i recently helped someone in a similar position where the bank themselves took out a claim and they had written to the bank and made an offer to pay just 6 months prior to the claim, and made a token payment.
I submitted a defence to the claim and soon after their solicitor issued a notice of discontinuance.
I even got them £400 in costs from the bank.

you just have to ask the right questions and ask for the right proof, each debt and situation is different which is why i never use templates.
