Thanks for the reply. I will definitely check out the local debt collection laws. I'm at a point of information overload. My house has been foreclosed on and I am close to being in default trying to figure out what would be a good step to take at this point. I'm having a block with the paperwork not sure what to do. I have a sense of urgency also so I can't get enough information. The mortgage loan is for 230,000 with a line of credit and a credit card involved in this. There's also some stuff in the house of personal that I need to get, doors are locked. I'm in the process of doing a search on the title and the deed. The debt is with Royal Bank of Canada and the solicitor has taken over the file would that be the solicitor that bought the debt.? What my thought was is sending the three letters but it is filed in the court. I have their statement of claim. Also I should note that there is a dual signature ,On the mortgage, not sure how to deal with that. Any input would be greatly appreciated. Thanks.

You could consider asking the court for an adjournment so that you can consider the paperwork the bank has given you so that you may seek legal advice and put your defence together. (Some have considered this site to be their lawyer when it comes to making the claim of consulting with a lawyer but of course this site does not and never can permit such a claim to be made because noone here offers legal advice.)

The solicitor who has the file may have arrangements with other 'partners' with this kind of thing and should not be dismissed. That's why I would seek an adjournment to review and study paper work relating to the case.

A bloke in Australia had his house stolen by the bank and got kicked out. The bank put a security guard at the house for a couple of days. When the guard was gone he got his own locksmith and moved back into the house. The whole eviction process had to be rerun all over again.

At this late stage I think an adjournment, a set aside or a stay of execution would be your best bet and then try to get it extended.

Thanks Ausk. I'm not going to get kicked out, lol, had to leave it and move for a new job. They did change the locks. So for my defense I could send the 3 letters?

There is no reason why not. You have the nothing to loose.

Please choose which letters you feel are the most appropriate for your situation.

Modify them to suit the laws referenced, the content of the laws referenced and the wording to Canadian equalivalents.
