I wonder if this any bearing to this, that of unregulated creditor etc taking court action & that of been the claimant:

It is a criminal offence to operate without a licence, i.e. unregulated, from what I take from the links below, I would take it that any unregulated creditor that operates without a licence has no legal standing in court as they are committing a criminal offence. In so far they cannot be the 'claimant'.

https://www.stepchange.org/debt-info/your-rights/consumer-credit-act.aspx
https://www.nibusinessinfo.co.uk/content/how-apply-consumer-credit-licence

Also appears that Administration of Justice Act 1970 applies

The Administration of Justice Act 1970
Section 40[2] includes a number of provisions forbidding creditors such as debt collection agencies from harassing debtors, including:
Excessive demands for payment
Falsely claiming that criminal proceedings will follow after failing to pay a debt
Falsely pretending to be officially authorised to collect payment
Producing false documents claiming to have some official status that they do not have

Another link here appears to confirm that unauthorised creditors cannot chase debt:

It is a point that can be used as part of a defence, and one that while quite complex in terms of the relevant provisions on the law can be quite easily summarised, indeed i have drafted the relevant pleadings and posted them on the forum so ill take a look around and see if i can find
