Hi , was hoping for some advice. I was issued with a CCJ in April 2012 and at the time wasn’t aware of the 3 letter process and therefore didn’t defend the claim and during that period was paying an agreed amount set by the judge. However, a few months ago I stopped paying and as I understand it after six years the CCJ is wiped off your file and marked as unsatisfactory if not paid in full. I’ve just recently heard from BW Legal that they have applied to the courts again. I’m wondering what my options are this time round and can they enforce still after this period. I’m expecting a claim from Northamptonshire bulk centre and I would really appreciate some help on this matter and whether this time round I can defend or stop them in their tracks. Any help would be much appreciated. It’s originally for a credit card for vanquis. Many thanks.

You are a long way off the six years as you only stopped paying a few months ago. The six years runs from your last payment or acknowledgement of the debt.

But your case has already gone to court and judged. You didnt defend and they would have got judgement in default. You will not get another claim from the court. They are applying to the court for enforcement. The only thing you can do is to set aside the original judgement because you didnt get the paperwork. But you have a problem here as well as you have been paying an agreed sum set by the judge.....unless you say you didnt know it was set by a judge.

Apologies my mistake, I was getting mixed up with another debt. This one although still in the six year period to enforce was a credit card debt purchased Lowell. During that time I have been back and forth with them using the 3 letter process and to date all they have provided me with is an electronic application form advising that because it shows application was approved this is a copy of the agreement. They sent me copy of default notice from original creditor and some statements that don’t show any payments I have made only charges that were supposedly purchased on alleged credit card which anyone could of typed out. I’ve even did the estoppel notice and to date they have ignored most of my requests. They sent me an email today which I have never given them notifying me that they have made an application to Northampton bulk centre giving reference number to their application of claim stating I should receive it shortly and have until the 10th October to respond either directly to them or on the claim.
