Reclaiming cash value for loans ive paid off in the past
Hi all, so ive been reading and learning a hell of a lot recently and i was pondering over a few loans ive had over the last few years which i paid off and a 12k loan most recently to consolidate some credit card balances. Has anyone tried sending letters to the bank/card companies to try and claw the cash value of the credit agreement you signed back at all using the whole "the bank didn't loan me their cash, where did that "money" come from" lines and all the usual stuff in the letters process to stop loan payments.
Also if you were gonna do this would you tip toe around the subject and play dumb or would a more go for the jugular approach "you've committed fraud, i created the money with my own signature, you misrepresented your information, there's been no transparency" and all the other arguments at them?
I often find myself at work (eurgh) thinking about drafting up a few letters and sending them to the banks where ive cleared stuff off and demand payment back as they would have effectively been paid twice..

This is something I am working on at the moment, not for reclaiming but as a defense for court.
Try researching Presumptions at law, & see if you draw the same conclusions as I am.

This has narked me ever since I learnt about the whole banking scam.
This is something I am also working on but I 'want' the jugular of my council first then .gov. Fraudulant b**st**ds have really rattled me.

Same here, I can't look at banks in the same way. I'm also in the process of going for it with 1 creditor that put me in a right overdraft pickle with RBS. The creditor claims no knowledge of me as I paid it off. Interesting angle. Especially since its within the last 5 years.

Besta luck with it but you are going up against some of the most powerful people and organizations in the world and they have plenty of money.
Even high court judges have loans and many of them have skeletons in the cupboard also.
In all mortgage documents there is an escalation clause. This means the banks can write to the mortgagee and give them 30 days to pay the loan out in full and bankrupt them if they don't pay. Many threats come in the form of a throwaway comment in relation to unrelated matter - that is until one thinks about it some time later.
Judges are human.
Not trying to put you off but just trying to show the scale of what your up against.
Lack of disclosure somewhere along the chain may be more fertile ground.
Lack of disclosure is fraud, fraud vitiates all contracts and there is no limitation on fraud in terms of taking action against them.
Being convicted of fraud in business is often fatal hence the tendency to want to quietly settle.
Even high court judges have loans and many of them have skeletons in the cupboard also.

No hope Ausk is there? Perhaps we should all just give up - NO! F**kem. I said I wanted to go for the jugular AND THAT IS WHAT I AM GOING FOR - PERIOD. This is my vow.

Payday loans are up against it at the moment which is what i was referring to, but for mortgages agree with Ausk it's one tough slog by the looks.. I have a litigant-in-person friend going head to head with a big bank over their loan to her during the recession and banking crisis in London and she has slightly succeeded going the fraud route (still in progress).
