Set Aside Application, Can Claimant Provide Proof Of Claim?

On making an application for a default CCJ to be set aside on valid grounds could the claimant use this hearing to provide proof of claim?

As i understand it this is not the case & that the hearing is only for (as obvious) to set aside default judgment so proof if any can be provided by the claimant at a later hearing where both parties are present rather than the 'unfair' default.

Could anyone clarify this?

There shouldnt be a hearing to set aside the judgement if the grounds are valid. It is judged without a hearing. Setting aside a default judgement is usually automatic, if for eg, you didnt receive paperwork.

And, no the case is never heard at a set aside hearing as this breaches court protocol of allocation of case to a track and court, filing documents within 14 days before hearing etc.

But what the defendant can do in its application to set aside is request the claimant to provide documents to assert its case (eg agreement, notice of default etc) with an unless order and say if the claimant does not do this within 14 days the claim is struck out - why waste an application when you can request other things you can also request. Draft a copy wording of the order you want to expedite matters.

They are valid grounds & not receiving paperwork is just one of them, I believed it would be automatic but research appears its not the case. It does state here you will have to go to a hearing:

The question though was because the claimant has sent documents that have never been seen from initial contact some years ago when requested, they've done the 'contact you again later when you've moved on so when can get the default CCJ manoeuvre'. & I believe they are trying it on by enclosing such for set aside date as SB is on the horizon should it be set aside then successful at new hearing .
