HI,

no i dont think section 10 still applies as now the DPA 1998 most has been thrown out. Now its the DPA2018 but cant remember which section to use. Somewhere between 30 & 50. Search for the legislative web site, I'm sure you will find it there.

Section 10 of the 1998 act was "Right to prevent processing likely to cause damage or distress". I would say the equivalent in 2018 would be Section 47 "Right to erasure or restriction of processing".

I'd suggest sending a SAR in the first instance. Any template would do, just tweak it a little as needed because there's no longer any fee and they have 30 days to reply (used to be 40 days). And of course refer to DPA 2018.

Once you have the information you can think about the next stage, writing to them to spell out exactly what information they need to delete and/or stop using, and why their use is inappropriate and illegal. There won't be a template for that yet but if you post up your thoughts or suggested wording then people can assist.

Just be aware that GDPR isn't necessarily a magic cure, there are lots of loopholes allowing them to claim entitlement to retain and use the data. That's why I think the second stage needs to be carefully targeted so they can't brush you off with a dismissive "legitimate interest".
