old married name on debt purchase letter Empty old married name on debt purchase letter

Post by LynnB on Sun Feb 10, 2019 2:53 pm

Arrggh, just come to do the 1st of the 3 letter process for a credit card debt purchased by Intrum, and realised that they only have my old married name not my new married surname, I used the card in the old name and never bothered to update the name on the credit card account as it never mattered I didn't feel previously, now though I do not know what to put on the letter, and what difference it may make.

I never sent a marriage certificate to them after having one lost by another company and not wanting to have my only remaining copy lost etc by sending anywhere.

Any advice would be grateful as I want to start the 3 letters asap as I was happily jogging on with my £1 a month payment prior to the debt sale and now it has me worried about the outcome again. thanks

Don't make their job easier for them.

In the agreement you signed with the original creditor, i.e, the people you borrowed the money from, is there a clause saying you would provide such documents as and when asked?

if not, don't even communicate with them, why make their job easier for them?

If you choose to do anything, consider writing to them and ask under what section of the contract/agreement you signed, does it compel you to provide such documents?? In fact, ask for a verified copy of the contract or agreement they are relying on for their authority to demand you send them any document?

If there is no such requirement in the agreement or contract tell them to go jump.

What you need to learn here is that under the law of contract, the contract makes the law. It's the contract that empowers you and them, its the terms and conditions of the contract that gives a party to a contract, the power to demand.

If it's not in the contract they have no power to require to you to give them a document (perform)

My advice to anyone reading this is that if they enter any written contract its critical to get and keep of copy of it for your reference so that you can prevent "contract creep" which with creditors and debt collectors is highly likely to occur.
