Final Notice - Bailiff Empty Final Notice - Bailiff

Post by Solosmurf Thu Feb 21, 2019 10:53 am

I have had a dispute with EE from 2014 which they refused to discuss at the time, they handed it over twice but each time when I contacted the DCA and told them it was in dispute they sent the account back. I sent signed for letters to EE stating that as they were ignoring me, I would return the favour and ignore all future communication which was in any way connected to them. I heard nothing until last year.
Then Lowell's started sending letters which I ignored until I received a letter from the Court containing a warrant regarding a CCJ . I contacted the Court informed them this was in dispute and filled out the necessary forms to get the decision overturned. These all stated the account is in dispute. I am on ESA but also get a student loan and for some reason the DWP refused the payment request. I was looking into why, they take their time and haven't come back to me as yet - since just after Christmas.

This morning I received a letter from the court Bailiff stating if not paid they would be attending with the auctioneers van and porters

I have a ROIRA on the window, does this help me in any way.

I signed everything in the house, informally, over to my son when he turned 16. He was bought a TV and PS4 by family as birthday and Christmas gifts as well as an electronic keyboard. Can they remove his belongings or should we remove them from the house just in case?

Final Notice - Bailiff Empty Re: Final Notice - Bailiff

Hi,
Do you have a written agreement of sale or a receipt. Its very important that this transaction is dated before
any bailiff involvement. If you do have it in writing ,get in touch with the bailiff and put him/her on notice that
nothing in the property belongs to you and you have evidence to substansiate it.
( anything you are not sure about remove from the house)

Remember if they turn up under no circumstances let them in .Once they have been in they are then free
to return at any time.

Hi,

There was no sale, just a one page letter signed on his 16th birthday which states

As from today everything in this home belongs to ***** ******, other family members may enjoy the use of these within the home but nothing can be sold or disposed of without his express permission.

I would think that should be sufficient ,It shows he holds title to it all.
Print a copy and send to the bailiff ,or if time is short email. It worked like a dream for me 30+ years ago.

Thanks, I have to call them tomorrow morning , I have a ROIRA notice on the window, it's been there since about 2012, I'll let them know about that too.

Final Notice - Bailiff Empty Re: Final Notice - Bailiff

Thanks for all the advice everyone, I've just received another letter from Lowell headed Notice of Aborted/Failed Warrant of control!

Apparently 'their client has asked that they review the case to provide advice on the next course of action to be taken.' While reviewing the case they have been instructed to contact me in order to discuss options for an arrangement to be agreed!

That sounds good. I would imagine the bailiff has informed them there is nothing he can do,and passed it back.
Now they will no doubt ask you nicely if you would please pay.
