Overdraft LOAN has been sold to DCA Empty Overdraft LOAN has been sold to DCA

Post by Prometheus on Mon Mar 11, 2019 1:35 pm

Hi Everyone

My wife had an overdraft with Natwest that was being paid off at £10 per month after she could not pay the high interest rates on to.

Bank has now sold it to DCA. DCA want her to carry on the £10 payment to them

What do you recommend to do - the 3 letters to DCA? any specific wording need to be added ?

Thank you
Prom

Welcome!

You would have to specifically use the templates for a debt purchaser - not DCA (See home page).

How much is the alleged debt for (to the nearest £1000 - to retain anonymity) ;-) ?

Your credit file will be affected for 6 years - which is why I asked how much (you may decide to instead pay off the alleged debt than have your score seriously affected for 6 years...)

reading your first post and the heading of the thread can you clear something up for me

is this for an overdraft ?
if so did they close the account then ask you to pay the debt off ?

overdrafts tend to be different to other types of agreements thats all.

yes it was an overdraft on the account
the bank are calling it a debt and
PRA are calling it outstanding balance

Yes I remember Tiggy saying overdrafts are different agreements
what is the best way to approach this

I was told a long time ago (old GOODF site) by a moderator that the template letters cover overdrafts - and I have followed that with success - BUT that may have changed, sorry (happy to be corrected) :-)

do you have any bank statements to check ?

or an overdraft agreement between you and the bank ?

did you exceed your overdraft limit ? or did the bank charges take you over the limit ?

there are a number of things with overdrafts that need checking.

Great questions -thank you
we do not have a copy of the overdraft agreement - it was one of those where they just gave you this cushion - then when the limit was reached the interest rate and min payment back would go over the threshold which was £4.5k

so did the interest and or charges take the balance to over the limit ?

there must have been some form of agreement and terms and conditions with the overdraft such as interest to be charged, what they expected from you etc.

A SAR to the bank should be helpful here

you could start by sending the first letter if you wish, but getting this info will certainly help further down the line.

Thank you Waylander -very much appreciated
Is there a good example of a SAR request to a bank on this?
