A short back story. Lowell bought an  alleged Vanquis debt. I was away from my home address for mental health reasons and  I never received ANY paperwork about Court Action.
How should a N244 to the court be worded for a set aside? I only found out about the CCJ AFTER  a SAR to Lowell. Any help would be appreciated.

How old is this CCJ ? Are you worried about your credit score ?

Just my personal view ,I would definitely do a SAR to the original creditors and see what comes back .

yes i agree a SAR to the original creditor,

to get a judgment set aside you would need to

a) give a good reason why you didnt respond in the first place
b) put in a good case that you have more than a fair chance of actually defending the claim

without the correct info then b) would be the difficult part

TBH I am more concerned about the money they say I owe them, I only found out about the CCJ after I went through the SAR from Lowell.
What should I be looking for in a SAR to Vanquis?

good question

do you have or have you ever had a copy of the claim form ?

so many things
an enforceable agreement
correct terms and conditions
correctly served default notice
account lawfully terminated
account lawfully assigned
any unfair charges or PPI type policies attached to the agreement
amounts claimed as owing correct

Just thought I would mention this, the Account number from Vanquis that has been used in the CCJ... IS NOT the actual Account number that was assigned to Lowell..

Also ive already 3 lettered Lowell and just received the normal " its just template letters you are using".. blah.blah blah.

that could be very important !!

the account number used in the CCJ ? is it a lowell reference number or an actual vanquis account number ?

you have 3 lettered lowell ? after the CCJ ?

The ACTUAL credit card number used on the Application to the court for the CCJ IS different from the actual Vanquis account number on the Credit card in Question. Only 1 digit out but is definitely the wrong number that was used in the CCJ Application. In fact ALL the copies of letters seen from my SAR were using the wrong number. The Card ended in 999 but all the forms  etc used in the court papers ended in 990

I HAVE 3 lettered Lowell but as I said in my original post I didn't defend the CCJ because I didn't know about it due to my mental breakdown at the time. I know I have to get it set aside in the first
instance. That's why I asked how the SET ASIDE application should be worded.

The copy of the Assignment letter  I got from the SAR selling the Vanquis account to Lowell was correct, using the number ending in 999.

All the paperwork telling me of the impending court action AND the Number used on the actual CCJ uses the number ending 990.

I hope that explains it better.

I feel that the CCJ was issued on a completely wrong account number making it invalid, would that be correct?
