Hoist finance UK holding intentions to issue proceedings in the county court , the said The notice of Assignment has previously been provided to me.
I remembered they sent me the application form that had been signed saying proof of owing the debt.
Please advise me what I should do now

you must respond to the letter before claim by requesting documents that you are entitled to see including an official CCA request.

also make sure you return the form provided along with your request(s)

A NoA issued by a Debt purchaser is meaningless as they can create these...

(The NoA that really counts is one that comes from the original creditor)

Exactly...

Therefore meaningless.

Even IF the Debt Purchaser (DP) has a true copy of the agreement, they also need the Ts & Cs. And even then, so what..? Means at some point in the past a loan / CC was taken out. And? Does that mean the debt is still outstanding / not paid off? Course not.

Where is the default notice to confirm the related loan / CC became a debt for whatever sum???

Where are the statements to prove the sums are correct etc?

Where is the Notice of Assignment (issued by the original creditor - who cares if the DP sends you a copy - they can make these up / I’ve experienced this before). Where’s the deed of assignment? Etc.

This is why a Subject Access Request (SAR) will reveal all (ie EVIDENCE).

The DPs need the paper work, end of (they know it).. W/o that, all they have is the hope they’ll scare us (which is all they’re trying to do) into paying some alleged debt. Well they can take a swing for it.

Hi mikeyjohn

You really need to redact the amount showing in the letter. Nobody else will owe that exact amount so therefor they can id you from that.

Yep you need to remain as anonymous as possible buddy. Personally I would never upload letters no matter how well you mask them.

And you can ignore their comments. It’s (yet another) fear tactic in the hope you start doubting the advice you’re getting here. We’ve all had the same or similar response and we’re doing just fine following the process - a process which we are completely entitled to follow and which is based on simple English law principles inc. contract law etc...

OK ,I have deleted them . If you want to put them up again I would suggest you only show the main body of the text,
no need to show the company name or the name of who sent it .Obviously do not show anything else that has already been mentioned.
It may appear to be over the top but if they monitor a thread they will understand your depth of knowledge & how concerned you may be.
For example if someone posts that they are scared of what may happen,its an incentive for them to put pressure on & get payment .

Hi just received this letter from moorcroft about coming to my home , they had written to on 4 occasion which I've not responded

scare tactics, they have no power whatsoever you can do a number of things:

send them a notice denying them access NOIRA

wait for someone to turn up and tell them to p*ss off and never return ( probably my preferred option )

or write back and tell them you DO NOT want anyone calling at your home and that you wish to deal with this ONLY in writing.

And I’d second that too! Their letters are definitely the worst I’ve seen as they REALLY ARE a template that never addresses your points, despite how succinctly you put them. Well they can ignore your points / requests for evidence all they like but they won’t get anywhere...
