Hi not sure where to post this...

A hand delivered letter from bristow & sutor has been delivered to my old address. I understand it to be regarding council tax arrears from several years ago.probably over 6 now.

1. Is it statute bared ?
2. They have the wrong address and probably the wrong name. Can they just change it to fit ?

Would be interested in hearing from others

I've had a quick look, Statute Barred is 20 years for council tax. I presuming if they have a liability order against you.
If they do not have a liability order ,they cannot get one after 6 years.

If its a completely different name to yours then its not for you, if its only a letter or two different it could be argued its only a typo. This is one very good reason to keep off of the electoral register. Try to get the recipient to return it " not known at this address".

Its hard to explain about the name. I have managed to change my first name to a nickname ( eg william to will ) not my name and remove a middle name. Even got dvla to change my licence. So not sure if that will be called a typo. Not been on any register with any council since, and trying to stay that way.

I agree with DI ask others see what happens. Asked own council even telling house is domestic & showing beyond ALL doubt ctax is commercial, sect 3 2(b) lgfa 1992 (remedy). They just laughed. Still paying, did I do awt wrong NO I do not think so, did I get it correct - YES so what went wrong - they just laughed & ignored me.

Question is HOW to proceed & FORCE THEM to not ignore me or acts, simple as. THEY are all theives.

I would send the following.
NOTICE OF REJECTION OF INVALID INVOICE


Reference: Your NOTICE TO PAY council tax CHARGE XXXXXXX dated dd/mm/yy.

This is a legal Notice, it means what it says. Notice to agent is Notice to Principal and vice-versa.

THIS IS DEFINITELY NOT AN APPEAL

This NOTICE is a conditional offer from me to settle the matter.



A Notice of Charge is subject to the Bills of Exchange Act 1882.

I require you to issue and deliver a properly formatted invoice, fully compliant with the Bills of Exchange Act 1882, for your charge or demand or order which is required to be legible and to include the following features:

Your registered company name, number, and address.

The date of the invoice and the date by which the invoice is to be paid.

A full description of the goods or services supplied or provided and the cost thereof i.e. what of value has been exchanged? (The CONSIDERATION).

Account for Value Added Tax, be this at zero percent or otherwise, and show your company's VAT registration number and comply with Regulation 13 paragraph 5 of the VAT Regulations 1995. If you are exempt from VAT, state this clearly on the invoice. I am required to account for VAT.

The invoice document must be titled 'Invoice' and bear a legible wet ink signature of an Officer of the Company.


Do not send any further mailings which do not contain proper invoices, as in that event you will be causing me harassment, and you may also be committing VAT fraud.

Personally I would not stir the pot ,they dont know where you are so dont tell them. Download the above notice and file it . You can use it if or when they do locate you.

As I posted earlier, they cannot get a liability order after 6 years. I would guess they do have one as these are pushed through their fake court in bulk. I cannot think of a way to find out without revealing your whereabouts .The court will have no record either ,as these liability orders are not issued by a real court.

Managed to get the " by hand " envelope and posted it back without stamps. Stating not know at this address.

Apparently some guy went round the old address and started shouting at the elderly lady there. Insisted on leaving a letter, which will be returned in the post without stamp stating not known at this address again. Guy needs a slap...shouting at an elderly lady
