SUBJECT ACESS REQUEST
THIS IS A TEMPLATE SUBJECT ACESS REQUEST (SAR), Its not all my work so I won't take full credit.
A SAR request is sent to the data controller of a company that holds personal data about you. Data is different to information so bear that in mind when tailoring the request for your specific circumstances.
The law is very strict when it comes to personal data so they take these requests seriously.
Dear Sir/Madame
Under the Data Protection Act 1998 I request that you supply all data in your possession that relates to these requests and am entitled to under Section 7(1) of the Act.
If you store older records on microfiche, the Information Commissioner clearly states that you must send me this in fully legible and comprehensible form.
I hereby request the following information;
Data on any agreement and all documents referred to within it
Data on any unexecuted and/or executed document
Data on any unexecuted and/or executed deed
Data on any unexecuted and/or executed declarations
Data on any legal or equitable assignments and novations
Data on any securities, notes, debentures, bonds or loan stock
Data on any transfers of title, to who and why
Data on entries in charges registers, to who and why
Data in any trusts and/or trust instruments
Data transferred and disclosed to any SPV to who and why
Data in any format disclosed to a third party to who and why
Data in any sales day books/sheets
Data on any transactional reports
Data on any accountancy records
Data on any settlements and closures
Data on any thing in action
Data on any instrument by way of legal mortgage or by way of mortgage
Data in any form by a power of attorney, to who and why
Data on any default notices, court orders or pending legal action
Data on any terms and conditions and any amended terms and conditions
Data on all internal/external emails
Data on all internal/external letters
Data in all stored telephone calls
I also require any and all of my data not already listed above.
If you are unable to comply with any of the above listed requests, you must inform me of such and give your reason why you can not comply.
I enclose the maximum £10 statutory fee to access all the data that you hold about myself. You have 40 days in which to comply with this request as under The Data Protection Act 1988. Failure to comply with this request will result in a complaint to the Information Commissioner's Office.
If you need advice on dealing with this request, the Information Commissioner's Office can assist you and can be contacted on 0303 123 1113 or at http://www.ico.org.uk

Thanks Daveiron, I do have another question. I am trying to target a specific account and don't want to muddy the data with other accounts held with them, however, as you pointed out I don't want to give them wiggle room. Would you target a specific account, its to do with a loan and its account, I also have a current and student with OD's.

If a Data Controller does not provide data you think you are entitled to or does not conform appropriately to a SAR then it is your right to send an additional letter to them explaining this. They will only have 14 days to comply, if they do not comply to this raise a complaint with the ICO.

I have requested an SAR recently and the Company has written back and said they have heard it all before and they are not giving the information and going straight to court - even though I have said I dispute the amount owed etc and requested an SAR....
What should I do now?

Smells like a 'sh*t-test' to me. Now, with an avatar like yours you probably have access to salt - take my opinion with a pinch of it please, at least until the other guys (aka the experts) show up with advice born of experience....
Send it again addressed to the CEO in his private capacity via posh post (registered/special delivery). They take more 'notice' that way usually....

The company is claiming that they are owed more money for the hiring compared to what was agreed on the telephone....also nothing was signed for on the site - so its word against word and they are threatening court etc

Surely then, what was agreed over the telephone is the agreement. It's their fault if they didn't perform a before and after check with signature/autograph.

This type of agreement/contract is enforceable and valid, the problem comes with proving who said what, and this is a common problem with parol contracts; and the reason most organisations use written contracts.

Subject Access Request
I have submitted a Subject Access Request (SAR) over a week ago to my local Magistrates' Court regarding Council Tax Liability Orders and an alleged driving offense stating:
CPRr.5.4.2 Supply of documents to parties including new parties,
CPR r.5.4(1) Supply of documents from Court records, and;
The County Courts Act 1984 1(2) - Every Court so held shall be called a County Court and shall be a court of record and shall have a seal.
They have not responded to me despite the rule stating they have 48 hours to supply the records. I did not quote the Data Protection Act 1998.
What should be my next step?

I was gonna say the magistrates courts uses different rules to the CPR and county court, they have the magistrates court rules guide, I have a copy of one of the post 2000 editions so I will see what there is in the way of disclosure, try the criminal procedure rules not civil, as they are treating it as criminal, albeit quasi or fake criminal.
Discovery is their Achilles heal if you use it to your advantage, I have a plan on C Tax but I cannot discuss it on the open forum but it involves knocking the VOA out of the loop, because its actually HMRC who are bringing the claim or the basis of the claim for rates, the council are just administrating your estate as a delegated function.
