I was wondering if you can point me in the direction for information for a court case I have this month on the 21st July. That horrible Arrow debt company and their Restons solicitors created the CCJ against me and are wanting to attach my earnings and I have actually honestly paid this debt off. I have proof. They are a disgrace. But, I need to be prepared and I want to counter sue what they have done to me all this stress. Plus they created the judgement when I was out the country. Please can you tell me in point form, what my defence should be and where I can find this information. Thanks so much in advance. Besides that I paid the debt but they are trying to say there is more interest owning which is nonsense. They are saying I still owe £690.00 I had a debt of £1,000 and I paid £1,540…

Just a few questions,

you say you been given a CCJ ,What is the upcoming case for ?
you say you have proof you have paid in full, is this from the original creditor ? what form does this proof take ,ie statements ,receipts etc ?

You need the evidence, you should have a receipt, a credit card statement if paid by card, or a statement of account if you paid through a bank or building society.

Once you have the evidence of paying in full you counterclaim for your costs which include a reasonable hourly rate for the time you spent on this case, and and all expenses you incurred and include mileage for travelling, a reasonable hourly rate, and ad hoc expenses such as travelling and parking tickets, paper for printing on and of course envelopes and stamps. You also include a claim for the stress anf harassment a fraudulent claim has caused you.
