Hi everyone Smile

I got few letters, one from Barclay ( default notice ) one from Hoist Portfolio Holding and one from Robinson way. It was a long time ago, a few months. Since then, they have sent me various offers, including half the debt. Does that mean my debt was sold ? Because I changed the address, I called them to give a new address, not mine, just for correspondence (in case they took me to court). I asked them to send me an agreement with them, but the answer was muddy (they said they did not) and that they would ask the original creditor. They asked me if it was my debt, I said I do not know what it is, because I do not have any agreement with them. Tired of waiting, should I send them the first letter? It's obvious, no contract they have. Or is to late Sad

Pleas, advice, Lukas

This is similar to what I sent to a debt purchaser .Adapt to suit.


Notice in Writing

Date xx xxxx 2017

Dear xxxxxx
I am in receipt of your letter dated xxxxxxx and received xxxxxx

Take notice I reject and rebut your assumption/presumption that I owe your corporation money.
As I do not intend to engage in letter ping pong I will make my position clear,you should read
this letter fully and carefully .
On the xxxx xxxx201? I requested from ( OC) a copy of my original agreement.This they have failed to do.
Again on the (Date) and the (date) and the (date) . (OC) were informed on all occations that I would pay
any and all money I may lawfully owe them upon proof of claim.They have also been served with a notice of
irrevocable estoppel by acquiescence and a section 10 notice of the data protection Act 1998.
Therefor take notice, no proof of claim has ever been provided to me by (OC) .

I am therefore somewhat bemused that if proof of claim existed (OC) would have provided it and been paid
in full instead of selling it for pennies in the pound.

Take notice that if you wish to continue with this matter I will require from you all of the following:

1. A true copy of the Deed od Assignment.Not Notice of Assignment.
2. A true copy of Deed of Novation signed by all three parties.
3. A signed statement from a named mam / woman from (OC) stating that no insurance claim has been made
in respect of this alleged account.
4. A signed statement from a named man / woman from (OC) that prior to the sale to you ,this alleged
account has not been sold or traded in any way.

Should you wish to send a collection agent or enforcement agent you will be required to supply the following:

1. A fully compliant risk assessment.
2. A fully compliant method statement .
3. Details of your Liability Insurance
4. Details of their Liability Insurance .

Also take notice this address is private property and as such ,recording both audio,and or visual is
forbidden .Should you wish to send an agent to this address ,you must beforehand write to make an
appointment enclosing a payment of £ 100.00 to cover my time as I do not work for free.
Should an agent attend this address without full compliance of my terms and conditions,their Implied
rights of access will be immediately and permanently removed.

You may also wish to note that I do not own this or any other dwelling,I do not own a vehicle.
All items,goods & property in or upon the land known as (address) or at any other location are not owned

All contact is recorded,
I require all correspondence to be signed by the Man /Woman who takes liability for its contents.

Host Portfolio are based in the Channel Islands they do not have a licence over here and therefore Robinsonway do not have the right to demand money. Just becareful how you word your letter. One letter was enough for theses maggots

Hoist Portfolio work under a Service Agreement to Hoist Finance (UK) limited who do have an FCA licence, it's a loop hole in the Financial Services & Markets Act 2000

A few months after I sent a letter to them (modified version from above), they sent me what in the picture. Can I completely ignore them, or is there any other letter worth sending back? Can they take me to court with this paper Smile ?

do they really think that someone is so stupid ?

They have not supplied a single thing you requested.

I would respond along the lines ; I requested from you specific documentation in order that I may settle any lawful obligation that you claim i have to you .
It has taken you xx months to respond to that request .Due to your failure to supply any of the documentation requested ,i now consider the matter closed .

What's the best step now? CCA SAR procedure?
They never sent me any documents although I requested it by letter (letters process)
Are they want to reset the counter by trying action in court? 6 years in this case will soon pass ...

I just wanted to let you know that after 5 years my debt was declared unenforceable.
My Credit Score was cleared a couple of weeks ago.
It was NoCA route.
in the final phase, I used a new route, with notices and affidavit way.

I would like to thank everyone here for the help they have given me, especially Daverion, who has helped me with brief, to-the-point advice over the years.

The most important line of battle is knowledge. You cannot simply copy and paste templates.
You need to know what you are doing and how to use the forms from this forum.
Dave ( Daverion ) showed me how to learn to talk to them, how to chase them into a corner (the art of war was a masterpiece Dave Smile )

Thank you all again and good luck to those who are at the beginning of the road. Remember, they have NO rights over you, and you have YEARS of time to learn how to deal with them.

Thanks good news, thank you for letting us know. Make sure you still keep all of the respective correspondence though for a a few years, just in case some other 'clever dick' tries to come along and demand that you still owe an alleged debt
