Thank you very much. As previously stated, I haven't signed any of my letters to them, but any further letter I send will be signed, and will add the bit about them not signing theirs.

Druid666 wrote:Thanks very much daveiron, much obliged. Just one more question. I haven't been signing the letters I sent, because Robber bastards haven't been signing theirs. Should I have signed them? The reason I ask is that DCA's have been known to photocopy signiatures in the past and paste them onto bogus CCA's. So, what advice can the forum offer. Again, all suggestions will be gratefully received. Thank you.

I would recommend when you sign any letter to these bottom feeders that you 'DO NOT' use your regular signature, that way should they be copy & doctoring loan agreements then it will not have an original signature on anything they put it on, over the years my signature I use is more unreadable as time has gone i.e. changed as the older you get the more rubbish you seam to sign.

Also regarding when they state along the lines of thanking you for your template letter - thank them for theirs too.

Haven't posted for a while, still waiting for Robbing B******s to send me a copy of the CCA. Keep getting letters stating they are still waiting for letter from bank (had 3 now). My question is:- how long do I have to wait for these people to either put up, or shut up? I know that while they are bogged down waiting for the bank to send copy of CCA that no one else will be able to have a go I'm just fed up getting letters saying they are still waiting. Any help or advice will be gratefully received. Thank you all.

Just be patient ,its a good sign that they are unable at present to supply proof of claim.
They will never say "you win" at best you will receive a letter stating that we consider this debt unenforceable .
& even then you will get a begging letter every 6 months .

Just had an interesting letter purported to be from BC, stating that because they didn't treat me very nicely in the past, they are going to refund all the interest and charges that were applied to my alleged account, after I "fell behind with payments". LOL. Could I please contact HPF to discuss the matter !! Has anyone else ever had one of these? Or are they just trying it on, in desparation?

I would be careful ,this may well be a way of getting you to admit the debt.In any event if they owed you anything
they would deduct that from alleged debt .
Your choice of course .

Daveiron, That was my thought exactly. Contact them about refund, and you're admitting debt exists. Can't believe how slippery these people are, and how stupid they think I am!! I was just curious to see if anyone else has had anything similar. I would still like to know what happened to Faljay. Last I heard he was quite ill, but that was before the old board folded up.

keep that letter in a safe place, very important.

it helps you a great deal but not sure what the alleged debt is for ?
a) If they now admit to 'owing' you money then you have a counter claim if need be
b) Again if they issued you a default notice for sums outstanding that were unfair and incorrect, this would invalidate the default
c) again if they 'owe' you, then the sums assigned are incorrect which should invalidate the assignment as the quantum assigned is wrong. the assignment is therefore fatally flawed as is the default.

handle wrote:WL62 - very good point re the assignment. I never thought of that.

trying this out at the moment in a case i am helping someone with, turns out PPI was owed , OC have offered a thousand and sent a form to sign ( not signed of course )

total proof that the assignment is fatally flawed as the quantum assigned is incorrect, defence is in.

also contract was an unfair relationship from the onset sect 140CCA take a look
