Re: Claiming your name
Hey Awake,
Good question, your person has different forms and you don't want to be the legal owner of it.
NAME is more like a state agency and the NAME is the organisational symbols for that person.
Then you have first name, second name, SURNAME. Your true name is first and second name ONLY, the surname is not yours. If you are using it it should be styled SURNAME, First name, Second name.
To take a larger amount of control over your NAME stop getting involved in contracts and learn about equity, you are the settlor and beneficiary of that person and should be in full control, but someone forgot to tell us all whats going on, so its up to us to teach each other and ourselves.
Trust law, equity, should grant you more control over your beneficial interests in your trusts and estates.....

Am I correct to think that without being the beneficiary and settler of the person one would str not be able to discharge claims etc

Re: Claiming your name
If your not the beneficiary and settlor then you are in legal world. Once the settlor has executed the trust the settlor is then out of the picture unless the settlor names himself/herself as beneficiary or trustee (do not be a trustee).

Re: Claiming your name
I have seen videos on YouTube about people accessing TDA accounts - am I correct In Saying that without changing your "status" in other words being the beneficiary And settlor you are potentially committing fraud ? I'm going to be studying trusts and equity

Re: Claiming your name
There is nothing to correct apart from your mindset, they may be talking about correcting their status under the UCC becoming a secured party creditor. You already are the beneficiary and settlor, you just don't know it yet.

Re: Claiming your name
Hi guys
Awake - it's a long road with no immediate fix. Like Waffle says it's about attitude. Just don't be impatient and impetuous.
The first thing that will help you re: status perception is to know that as soon as you receive an 'offer' to contract from the legal world you have to write back (via posh-post) within 72 hours to rebut their presumption of your status. They presume you to be the legal person, put them right.
If you want to try the UCC route make sure you FULLY understand it before filing. i've been looking at all this stuff for 2-3 years and the only thing i fully understand is if you get it wrong you're toast!
Try Troy's vids - not really about equity or trusts so much, but a good place to get some good general basics.
Also Steve Mccrae - he covers matters similar to TDA and very knowledgeable.
Cheers!

Re: Claiming your name
Suggest that you research adminstration of the legal person.
A bloke in Aus I listen to on a Tuedsay night on RAT FM who seems to have a lot of expereince in the court system, says there is a way of acting and appearing as the benfiricary of the legal name and at the same time making the state, the administrator or trustee if thinking in terms of trusts.
