according to their letter they have sent you agreement, default notice and statements is this true ?

Thanks for your message. I have received a copy of a default notice from May 2015 but with no signature only 'Tesco Bank Collections'. A copy of an agreement but with digital signature, a set of terms & conditions & a batch of statements?.

I sent the 2nd DCA letter to Lowell solicitors last week & have received the attached reply. They have obviously not sent me the information requested, as stated in the first line of the letter.
I am due to send the 3rd letter on Thursday & will do so, but would appreciate your further guidance on this.
They also state that a legal claim form will be issued against me if I don't respond to them to arrange payment. So could this letter be taken as a letter before action?.

Thanks for your message. So in your experience when things get to this stage, (I am going to send letter 3 tomorrow but plan to point out specifically what they have & have not sent me), what are the probabilities that this will proceed further to court?.

if they think they have sufficient evidence ( and thats not much) in todays system , they will send you a letter before claim and then on to court,

it appears lowell believe they have the evidence they need so a claim is likely.

On that basis then & on the evidence that they don't require much to win a claim, (& I don't want to run the risk of getting a ccj if I can help it), I may decide to cut my losses & try & agree a repayment plan with them. What do you think?.

i) agreement with digital signature ? did you apply online for this card ?
ii) default notice ? doesnt need a signature but needs to be compliant with the CCA would need to see it
iii) notice of assignment ? you dont mention this ?
iv) batch of statements ? have you checked through these for any form of PPI insurance or payment protection ?

is this a large debt ?

Thanks for your reply. My answers are:
i) Yes I applied online.
ii) default notice attached.
iii) Notice of Assignment - this was sent to me by Lowell Portfolio in Feb 2018. I have also received a 'Notice of Acting' from Lowell Solicitors in Nov 19.
iv) there is no evidence of PPI or payment protection on the statements.

The alleged debt is approx £5400.00

this does seem in order

I hope your well!. I have sent the 3 letters to Lowell Solicitors, for DCAs (not Debt Purchasers), in accordance with a previous post from you, & I am now due to send the Estoppel, if its still the thing to do?. If so can you please direct to the correct template to use?.
I haven't received a letter from them since I sent the 3rd letter a month ago!!.

Actually the estoppel is not recognised in court. Cases and actions will still continue after serving and the judge will not pay any attention to it. The only thing that carries weight is a reference to anything in statute or act of parliament that the other side has not complied with.

If matters ever progress to a higher level such as the county or high court, the Estoppel becomes very powerful as these courts operate under common law and not statute law and under common law you have remained in honour, and they (e.g. a debt collection company) have not.

If either of these courts acts against you for following the correct processes and ignores the fact that the recipient of the three letters (e.g. a debt collection company) has not, you can often get a default judgement against the judge for also acting in dishonor and this is powerful.
