Statute barred and delayed default

Statute barred and delayed default
On checking my credit file there is an old loan where it shows 2 months arrears in Feb 2012 with no changes from then still shows same balance and 2 in the months in arreras. The default is showing as being registered in early 2017.
Obviously I want this off my file as soon as possible what is the best way to go about it.
What is the best way to go about it. It should be statute barred if it doesn't show any payments and I don't recall ever making any. No one is currently chasing me for it and it is still with the original bank as far as I can tell from the credit file.

best thing you can do here is send a full SAR to the bank, get all of the information held for this account.

I just don't want to be poking round if it's gonna cause issues unless I'm sure it's statute barred but don't know how te recent Doyle case applies when the default is registered so far in advance. I'm not sure if they sent a default notice in 2012. If so I don't know how I can prove it if they withhold it.

the choice has to be yours
but i cannot see how else you will be able to tell what has happened if you dont have any paperwork yourself.

Any idea what the statute barred date would be though? If new advice says day of default being issued surely that can't apply where they don't register the default for years

it is date of default notice being issued, you could argue that the issuing of the default was unfair due to the length of time.
If you dont want to cause too many issues then simply submit a SAR for a copy of the default notice ONLY, you can request any data you wish.
this is crucial to your argument regarding statute barred.
purchasing DCA'a are notorious for changing default dates which they cannot do !! you need to find out what has happened.

It's showing as still with Natwest what is the course of action of no default was sent. Complain and appeal to ico if no suitable reply?

if it still with the bank, you could go into the local branch and ask for information regarding this particular account, i did this myself. The local staff will have no clue about the default or anything but may be able to give you a statement as to when the account was closed.
if last payment was definitely 2012 then it should not have been registered as a default in 2017 that is unfair.

it does look statute barred but your only option is to get that information as evidence
only the bank can give you this information if you do not have it yourself.

I know for a fact there was no payment it just depends when they want to say the default was due. I shall give it a month before I complain about the default date so its 7 and a half months past the last payment and a month and a half past the term end date.

statute barred is when the default notice was issued.
by not finding this out as early as possible you are taking a risk by complaining about the default date.

I realised why I had stopped taking notice of this one as I got a letter when Moorcroft had it in 2016 saying the bank couldn't find the agreement. I shall sar them now.

Natwest have agreed to remove the default and give me £200 compensation

It's the default on my credit file that's being removed exactly what I wanted. The debt was written off long ago
