Spot on Waylander62 as always. I would not be worried, all part of their rather pathetic 'scare mongering' tactics.

Hi Guys

Just thought i would give you an update received a reply to my last letter. Intrum have reviewed reviewed my account and have decided not to proceed with litigation at this moment in time.

The account is being transferred back to the collections department then the usual blurb contact us within the next 10 days to discuss repayment options etc so I think for now I have had some success but it's not over yet

Doesn't it just!

Hopesprings: Keep on top of the SAR still i.e. make sure you get that in full from Tesco... You will likely still need to rely on it in the future l)

not acceptable, complain to the ICO.

if you actually think about this it could be beneficial because Tesco refer you to intrum in respect of the SAR, intrum dont have the necessary paperwork therefore it doesn't exist.

If somehow it appears then...... hmm how has that happened ?

Agreed with Waylander. And to add to that, the comment from Tesco's is BS. Why? Because YOUR personal (financial) data ORIGINATED WITH THEM! And hence Intrum will have a copy of all of it (VERY unlikely...) or a subset of it (more likely, as part of their debt purchase). If you refer what tesco has said to you to the ICO (e.g. send a photcopy of Tesco's letter), the ICO will soon put them in their place Wink

Send something along these lines to Resolve call;

Notice to Cease and Desist

Notice to principal is notice to agent. Notice to agent is notice to principal.

I have received a letter informing me that you intend to call at my address in
regards to an alleged debt.
Take notice your implied rights of access are hereby withdrawn.
This is Private propertyand all callers are strictly by appointment only and
subject to my terms and conditions listed below.

Should you wish to make an appointment, there is a standing charge of £5.000
per each visit (i do not work for free). This appointment is for the duration of
one (1) hour or part thereof.
A request for an appointment shall be made in writing in not less than seven
(7) days and shall contain the sum of £100.00 being a non returnable deposit.
It will also be accompanied by a copy of your Health and Safety risk assessment
and method statement.
You will also provide details of your Public liability insurance.Three forms of
identification will also be required.
You will also provide 7 days prior to any appointment all documentation to
provide your proof of claim of the alleged debt.
No recording whether audio of video is permitted upon this property and will
be strictly enforced.
I look foreward to your business.
--------------------------------
I notice you are ignoring letters from them ,this is a big no no.
Either a quick letter rebutting their claims is all you need or alternatively
you could use the Notice of Conditional Acceptance .but only when you
have done research into what you are asking for and why.

Agreed with DaveIron and the same applies to anyone reading. If you choose to ignore letters, then you'll sadly get what's coming to you as they say... Just like any problem in life: ignoring it does not make it go away. And in fact, it usually gets worse. And before you know it you may end up with a CCJ if you don't follow the process correctly...

(Excellent letter suggested too)

Don't have a contact address for resolve call nothing in the letter from intrum it just states they will pass to resolve call if i fail to respond, I have been ignoring the letters as they are just the same thing all the time sometimes asking for me to pay in full or others saying they will except x amount of pounds in payment. I know what they are asking for but they have been unable to provide the correct documentation this has now been going on for over 2 years so i think if they were going to do something they would have now

Use a search engine for their address, better still use companies house to
get the name of the CEO.
An unrebutted presumption stands at law. Its your choice.

They might not have legal powers but do you know sure 100% they won't turn up and harass you? Exactly... Wink

As such, in my opinion and my experience (goes back many years, and I have dealt with Resolve Call....) take Dave's advice.

Good luck!
