Waylander62 is correct. However often, and from personal experience, it can take a longer and I have needed to complain to the ICO as a result. One took many months. Despite the legal obligation on them (to reply within a month) many companies - esp debt companies - drag their feet (I wonder why.........................!)

Also from experience make sure you get EXACTLY what you asked for, they are quite fond of giving what they think you asked for. Shocked

Update

After receiving the letter from intrum threatening court action i replied acknowledging the receipt of the letter and telling them i was seeking legal professional advice and they hadn't provided any of the original documents requested in my previous letters. Any way I have now received another letter just stating how much the debt was for and the date it was assigned to them and requesting I contact them to arrange a payment plan no mention of court action? Do you think that because they can not provide the original documentation they have changed their stanch. Would welcome any advice.

difficult to say what this means, it is likely to be just another template that their PC has flagged up needs sending.

remember these DCA's in the main are useless and the left hand have no idea what the right hand is doing so stay alert and wait for the next letter, in the meantime chase up that SAR.

100% agree with Waylander62. These DCAs are pathetic and, personally, I have easily shaken off at least four easily so nothing to worry about Smile

I would as the ICO did get onto the organisation in question in my particular case and they provided more info (still not all of it though tbh...) I also tried to claim compensation for the org taking over a month (the limit) to provide all SAR docs but the ICO said I would have to deal with that myself (thanks!!)

Also, check out this excellent post (jump to Sunday May 19, 2019 3:48 am) from assassin which 'translates' some of the wording that the DCAs like to use to mislead you / try to pathetically induce some sort of fear ;-)

Update on intrum have now received another letter they want to help me pay my debt without taking me to court, They are willing to give me a discount if I contact them with 10 days and pay it in full no mention of how much the discount will be should i respond in any way at all or just ignore this latest letter.

Other than to rebut their presumption that you owe them money if you wish.
That letter is to intice you to admit the debt. If they had all they needed
to get full payment via court ,why would they be offering you the chance to
pay less ?
Otherwise do nothing until you get all the info from your SAR.

DI is right, on every point. The Debt company knows the debt is not enforceable legally and so this is their way of at least trying to get something from you rather than nothing. So with that in mind, look at it as a small victory that they’re unwittingly admitting their claim represents nothing more than an alleged debt Wink

update

Received another letter from intrum they are planning to hand over the account to their legal team on the 7/02/20. They may apply for a County Court Judgement to demand i repay the money by a certain date.
If a judgement is granted they can apply to the court to issue
An attachment of earnings
A charging order

Have now written a complaint to the ico regarding tesco's and the sar
Do i respond in any way?

Our are they trying frightening tactics

Its just the usual next step , Notice the "we MAY", not we will.
If they had all they needed they would. If you have completed the 3 letters
you can ignore if you wish. Personally I always rebut.
Something along these lines is all I would do.

I am in receipt of your letter dated xxxx in which you have again failed to supply
a valid proof of claim .I once again rebut and reject your presumption that I
owe a debt to your corporation.

Update

Hi
I have received a letter from the ico confirming they have received my letter of complaint nothing back from them yet.

I have received two letter from intrum Legal Department both date 10.02.20.
One introducing out legal team they now have my account and they are in charge of getting a CCJ issued against to demand i pay the money back.
If I don't get in touch in 10 days they will pass to their solicitors.
Again if I don't they MAY apply for a CCJ and the court could also demand i pay the court costs.

Second letter responding to the letter I wrote to them they have acknowledged my request for a copy of my credit agreement pursuant to the section 77-79 of the Consumer Credit Act 1974

They have now requested this from Tescos as this debt goes back to 2008 how successful will they be obtaining this.

In the interim they confirm that no further action will be taken against me in respect of this matter by them until the credit agreement had been provided.

So what does this mean for me?

Any advice is welcome

that means they can do nothing except ask you to 'donate' money to them until they have fulfilled your CCA request.

so have a break but keep pushing for the SAR

Update
I have received Right of Access documentation from intrum am i right in thinking this is a SAR I thought this would of come from Tesco's the original creditor.
Doesn't really tell me a lot just copies of the letters I've sent and what they have sent me about 5 pages of email messages and of copy of my credit card application that dates way back.
Is this what Tesco's would have sent to intrum when they purchased the debt and is this all that both parties have.
The account is still on hold whilst they await the requested information from Tescos wouldn't tesco's have provided everything they have already?

Any advice
