Hello,
       After reading through a load of stories i thought id ask my own questions., Got a letter today from my credit card company stating if i dont pay by end of this month my account will go into default and will affect my credit file blah blah.

Would it be the time now to start the 3 letters to them or wait until they sell the debt on?

Thank you in advance for any info you can help me with, ive seen this works for alot of people on here and wanted to give it a try.

Not sure if it helps but the debt is for just under 4k

Let it go into default. They should send you a formal default notice.
Remember to keep ALL correspondence in a file.
They will no doubt plague you with phone calls & texts .when that starts write to them and inform
them that you only give them permission to contact you via Royal Mail. Under no circumstances
engage with them over the phone (its so easy to slip up,& they will be recording)

Agree totally with DI's approach. Make sure you stay organised / keep all your and their letters in chronological order plus staple or your proof of postage receipts.

And some more info to consider / be prepared for Smile

There’s plenty of help on hand here. A good and friendly bunch to be found, so you won’t feel alone. But to be safe, and at least until you become comfortable with the approach etc., I recommend that you only take advice from people with at least 2 or 3 stars against their profile as it’s not been unknown for the odd troll (Debt Purchaser / Debt Collection Agency / solicitor even) to pop up masquerading as a legitimate person in need of help but giving out misleading advice... Having said that, the fantastic admins / moderators (thank you friends) on here do a stirling job kicking the trolls out :-)

ALSO: before you post anymore, NEVER use personal details inc reference numbers, never alleged debt amounts (just round up to the nearest £1K) and never dates of the letters your receive or send. If you ever intend to upload photos of the letters you send or receive (I recommend you don’t) also be mindful of the above ie mask any such details (and mask any references or barcodes etc that appear on ANY part of their letters...!) Pretty much anything that helps maintain your anonymity (again, those potential trolls...)

Also, some terminology to note as there can sometimes be a little confusion (GRANTED - you're not at the debt purchaser stage yet):

Debt Purchaser: purchases debts from an original creditor (OC) or another debt purchaser (yep, these debts often get sold over and over...).

Debt Collection Agencies (DCA): simply collects a debt on behalf of a Debt Purchaser.

Note: Some people refer to Debt Purchasers as ‘purchasing DCAs’. Fine of course, but it’s important you at least know what a ‘Debt Purchaser’ and ‘DCA’ are when picking the correct templates / dealing with these scumbags...

So if you’re dealing a Debt Purchaser, templates which can be found here:

Remember to send the template letters 10 days apart and by Royal Mail signed for delivery. And make sure you download a PDF of the signature once each letter has been delivered / signed.

With the first letter you send, also send a Removal of Implied Rights of Access which can be found here:

Whatever they send in reply (unless it’s from a solicitor on their behalf - VERY unlikely at this stage, if ever - then don’t worry and keep to the letter system / timescales. The fear (an IMAGINARY obstacle, nothing more in this context) does go, trust me. As one previous moderator once said: “it’s just people in an office...”.

You will also learn to see how incompetent so many of them are and I have come across plenty of examples from debt purchasers and debt collection agencies.

You’ll also start to sense the frustration in their letters - which should tell you all need to know... ;-) They’ll bandy about phrases like “we are aware you are using template letters” (and they aren’t?) And “we may litigate” etc (if I had a £ for every time they said “may”...) And so on.

Again, there will only ever be anything of any potential concern if they ever say something along the lines of “we will be litigating / you will hear from a solicitor” etc. Note “will”. Those responses are important to deal with and should not be ignored. They also often try to mince with your (and their) words as well as twist your words. Who cares; there’s no room for lack of interpretation in OUR letters. You get the idea...

So; as long as you’re organised (get a folder - my one is pretty thick now!) / keep copies of your letters (and theirs i.e. those of the original creditors, debt purchasers / collection agents) - and your recorded delivery receipts / signatures - you’ll be in good shape and find that the three letter template approach works.

I’ve been using the system with success for years as have others and one debt Purchaser has already admitted the account they have for me is not enforceable in a court (ie implied admission they do what was asked of them in the letters i.e. they cannot EVIDENCE any alleged debt...) ;-)

Perhaps, as I do, keep your folder out of site and forget about it and the low lives and get on with your life without fear in between receiving and sending letters.
