Hi All
I am new to this site and would appreciate some help regarding the above.

The claim relates to a previous payment arrangement set up by CAB a few years ago before I had much understanding of how the debt scam works.
I had been making £1 per month payments which stopped due to inability to pay. The DCA has applied to the court for a CCJ I believe.

I I able to defend this as payments have been made in the past?

Can I still ask for proof of claim?

Is MoneyClaim online my best option to declare an intention to defend ?

Is it 19 days from the date of Claim form creation to declare intentions either way?

the first question i have is to " the DCA has applied to the court for CCJ i believe"

have you received a proper claim form making a claim against you ?

yes you can still defend but the payments may make it more difficult

yes you can still request proof but you should have used the pre action letter and the forms to do that prior to the claim being issued

online is as good an option as anything else

yes 19 days to declare your intentions

then you need to get yourself into action to start defending

yes the paperwork has arrived.

If there is fraud involved ie the debt is not real as I am the Creditor and as the Bank committed fraud and the CAB duped me with instructing me to offer small payments then they are complicit in the fraud surely a reasonable defence

I get your point about having already made payments = weaker

Just found out that the online method no good as Gateway username etc required

May just have to give up on it.

Anyone challenged the lanquage fraud all caps?

forget this route unless you have an in depth knowledge of the system and the law

you must decide whether to give up or try and fight it, in order for anyone on here to try and offer some assistance more information would be required but you dont have long.

please post up your intentions asap as a challenge or at least proof that the claimant has the right to sue in respect of the account needs urgent action
