While I appreciate honest responses, please there`s no need for arrogant comments like I feel I have had in the past.I have recently took a court claim out against British gas, the back story is they took over as my gas and electric supplier. That was in november 2020, i december 2021 I began to have problems, I paid for my bills via cheque, after a while cheques stopped being cashed and my account fell into areas.

After threats of debt collection and key meters being fitted I paid the fee, this then happened again despite me having a complaint open, again I paid the fee, but asked about the fees that in my view I never agreed to, I also quired the defaults on my credit rating this was dismissed by the complaints handler, he did refund a few charges.

The problem persisted and I later managed to submit a meter reading, as I expected british gas owed me around £400, I had attempted to submit meter readings on a few occasions but the website would always say they couldnt accept it at the time. I had attempted to call british gas to discuss the matter and was hung up on after being on hold for 2 hours, I had also previously wrote to british gas and said I felt my time was being wasted and that I reserved the right to charge for my time and sent them my own fee schedule.

After my property was sold, and after I had missed a mortgage payment, british gas messaged me on facebook messenger saying, they would sent me the final bill in 10days on august the 9th. They quoted the account was £405.99 in credit, by the 30 of august I has still not received the bill for the £405.99 credit which was money I needed at the time.

After contacting british gas again, they sent me a new figure of £315.38, saying a fee for "debt collection" was added this was after they had told me no fee would be added for that. eventually well into september british gas contacted me offering me the £39 back, I was still skeptical as from my point of view they changed the rebate amount with no explanation, the complaints handler then informed me there was another £20 she could refund me of view.

After receiving the final bill I noticed there was another £7 late fee which I claimed I had not agreed to pay, so they sent me a second cheque. I said at the end I felt british gas had wasted my time leaving me on hold for hours, cutting me off on the phone, and withholding my money. They had also threatened me with key meters and forced entry to my property, I also claimd that sending my details to a third party was against the 2018 data protection act, against GDPR rules and the 1997 protection form harassment act.

They offered me no explanation as to why the rebate was not £405.99 as quoted, and I had to borrow money from a friend to cover some bills while I waited for british gas to send me the refund, they also questioned my meter readings and at one point claimed I had sent a picture of my water meter not my gas meter, which was not the case.

I have entered a claim against them and there response has been large refering to the so called "contract" and that because the cheques where not cashed it was my fault effectively. They also claim they where within there right to contact a 3 party debt collector and pass my details on as thats also in "the contract".

Any thoughts on the matter or advice would be largely appreciated, I`m not hell bent on winning to be honest, I want to prove my point more than anything.

if you feel you've had 'arrogant comments' please can you show where?

Remember these parasites are not really willing to engage on any level unless there is a direct debt (DD) in place. I too have had responses where having tried to get something resolved its far from being finished. The DD is for them to be constantly on the take, a 'bill' is generated, 'pay it or else' mentality, don't matter who's right or wrong.

This is difficult even for me to give a concise answer because there too many if(s), why(s), & wherefore(s).

You may be aware there has been a temp' stoppage in the forced install of pre pay meters for now? These people generally will not engage properly because I beleive all they want is to profit without giving any proof of what it is they claim (contract/agreement or otherwise). In other words situations are created without merit, everything is obfuscated, if they owe you unless you can prove beyond reasonable - even then as you are experiencing, its difficult to get it resolved.

You could try the Ombudsman, done that been there, was a waste for me, it may work for you.

Before your court case can you work out your correct bill from scratch, based on real meter readings?  We can help if need be, but you need the tariffs and ideally meter reading at the times the tariff changed.  Then you'll know exactly what BG should have charged, which can be compared with what they claim.  From what you say there's no doubt you ended in credit, even if they're disputing the final amount. So can't see how any debt collection fees can be claimed.

I don't think you'll get anywhere with the data protection angle, they will claim legitimate interest, which is almost certain to be accepted.

What stage is our court claim?

Hi thanks for the replies, I`m not at the property in question anymore. Its a complicated situation the property was empty for almost 4 years as I was selling it. A representative form British gas said the reading where the same since November, so they where stalling on the final bill asking me for photos of readings etc, and at one point saying i had sent a photo of my water meter when i clearly had not. They basically decided to bring the reading back as an estimate.

They said to me I was in credit by £405.99 said it would be with me in 10days the final bill it never was, which is one of the points I`m going on allot cause they set the agreement and went back on it. I will send there defence response, its basically refering to a "contract" which I never signed and they give the bull of we didnt charge you those as a gesture of goodwill.

I will send a bit more information tonight if that ok, as I`m not the best at articulating my points I know. thank you guys for your responses so far.
