Hello Everyone

I have 2 credit cards that that have gone into notice of default. I have been reading the posts on the site trying to gain advice, is there a guidance at what stage I do SAR and at what stage I start the letters process? I am currently unable to fulfill the repayments. I would really appreciate your advice. Thank you.

Hi again, i have 3 credit cards that have been passed onto debt collection agencies (Lowell, PRA and Cabot) I have spoken 2 of these debts on the phone as i told them i was going to enter into an IVA and they proceeded into placing my account on hold. I have since decided against the IVA and was wondering as I have spoken to them on the phone will this therefore stop me from being able to send the 3 letters as this could be classed as acknowledging the debt? Thanks for any advice

Ok ,it should not be a problem.
First off seperate the 3 accounts and keep them in their own folders.
From now on only ever deal with them via Royal Mail.
It appears some if not all are debt purchasers.check any letters they have sent
to see what they say.
in the meantime study the goodf approach and then the Notice of Conditional
Acceptance for Debt purchasers.

PRA = debt purchasers
Cabot = debt purchasers
Lowell = debt collectors & debt purchasers
read lowells letter to see which they are.

You may as well make a start and send a DSAR to the 3 original creditors
Also just a quick letter to each of the above to inform them all contact must
be via Royal Mail and you do not give permission to be contacted in any other way.

I personally had PRA chasing me for £5 K and got rid of them with the NoCA
route.

Thank you. I sent the 1st letter to Westcot and they have referred back to Tesco bank as said acting on their behalf. Tesco have sent multiple documents and the pre-credit information states on 16.5: Who do you share my information with? One of the bullet points states: with other companies that help us to provide our services including companies that provide or may provide funding or services to us or help us recover debt and (new bullet point): with other lenders or companies to whom we transfer or may transfer our rights and obligations under our agreement with you.

I would be grateful to receive your advice? Thank you.

Usual type of response. Have Tesco complied with the DSAR , and provided
everything they have? That should be all statements ,copy of original agreement
and every thing else.

As you are dealing with 2 or 3 different accounts at the same time,
it would be better if you created a seperate thread for each one.

They have sent original true copy of credit agreement, current copy of credit agreement as varied, current statement of account, signed on behalf of Tesco (no statements), original copy of T&C, current copy of T&C as varied? Nothing signed by myself. Thank you.

As they are required to send everything (if thats what you requested)
Then either they have failed to comply or there are no statements.
If they claim the original agreement is a true copy ,where is your signature ?
and who from Tesco is taking liability under penalty of perjury that is your
agreement.

Personally i would respond asking if all they sent you is all the data they hold
for you ,and if not ,why have they failed to comply.
