Two Cabot debts transferred to Resolvecall for recovery
Hi
I received 2 letters from Resolvecall stating that they have been instructed by Cabot Financial to recover the 2 balances I owe. They are from a Lloyds Bank loan and OD. I was given the loan in 2008, after I'd been diagnosed with breast cancer. It was at the time when you actually got an appointment with the Bank Manager and the loan was approved and arranged then and there. The manager was fully aware of my predicament and that I would have no income during the time I was undergoing treatment.
Neither of these debts are on my credit file. I originally sent Cabot the 3 letter process back in 2016. All was quiet for a while and then the letters resumed in 2018. They have increased in frequency since and I have been getting 2 a month for some time now along with relentless phone calls and voice mails. I have blocked numerous numbers but they always come up with another. I have also noticed that I sometimes get a voicemail without having had a call !!!
Should I now use the 3 letter process with Resolvecall, and should they be the Bank ones I previously sent? I believe the last time I made a payment towards these debts was back in May, 2015.
Any help will be very much appreciated.

I have been through all the documentation I have, from Lloyd’s and Cabot and cannot find a default notice. These debts are not even on my credit file so I can’t check there either.

i would suggest a SAR to the OC in respect of the loan.

Sorry Mrblue , but I'm not sure what you mean by removing actual sums and dates. Do you mean the debts I owe? If so, I have never included any dates or sums owing in any of my correspondence.

No you shouldn't ideally. Send using the Royal Mail Signed For service (approx. £1.90).
Keep the SAR simple as follows:
"This is a Data Subject Access Request. Please supply all of the data that you hold for <enter your name and address> including any and all documents that include my personal data. Please supply all data held, within the one calendar month as per the DPA requirement."

In response to the Notice in Writing letter I sent to Resolvecall, they put the account on hold until they had a response from Cabot. They have now written again stating that Cabot have provided all relevant documentation back in 2016. They then say that I, the customer, have already acknowledged this account as stated in their final response letter. I don't know what they are talking about ! Resolvecall is now threatening to start collections activity with calls and letters.
I am getting very stressed as my knowledge of what to do next is very limited. I would be grateful for any help. I am having major surgery in April and this is all getting too much. You have all been a Godsend. many thanks.

Just for a start ,write to them . Inform them you will be having major surgery
as you stated and that their contacts are causing you considerable distress
at this time.

Just an update on the current situation. I have just written the 3rd new letter to DCA, Resolvecall who has supposedly taken over from Cabot. However, I am still receiving calls and mail from Cabot. Should I also reply to them now.

Can't you simply block their calls? That's what I would do. Personally, I never answer withheld numbers or numbers I do not recognise. In my opinion, if a call is ever that important, you'll be left a voicemail

I have blocked umpteen numbers, they just use different ones and now they even manage to leave voicemails with no record of a call having been made!!

If you did inform them of your health issues as per my post 3rd march and they are
still calling .Its time to contact the FCA also point out that you have withdrawn
your permission to contact you via the phone (its in the 3 letters) .
If for example you sent them 3 letters thats 3 times ,so inform the FCA of that,

Just to be clear on the roles, can you confirm that Cabot claim to now own the alleged debts, which would make them a debt purchaser in the terminology used here? And if Resolvecall are "acting for Cabot" that makes them a Debt Collector (DCA)

DCAs have (IMO from experience) NO power, unless you give it to them. By that I mean leaving your doors/windows etc., open. this has to be a result!

Resolvecall - as a DCA - have no legal power whatsoever.
They’ll try and convince you to the contrary hoping you’ll fall for it. But they haven’t. End of.

Thanks, I have had a letter from them stating that they have put everything on hold until they get the documents I've requested. I've sent the third DCA letter and am waiting a response.
What I find strange is that Resolvecall have stoped phoning but Cabot continue to call despite informing me that Rerolvecall would now be dealing with the matter on their behalf !

log each time they try and contact you and keep the evidence
