The Mask

KNOW THE LAW!

Remember, according to social distancing, shop staff cannot “touch” you or come within 1 metre without breaking guidelines, (but of course they touch everything you’re buying)  and if you refuse to wear a mask in their shop they cannot physically throw you out, but can only call the police to enforce a government 'guideline'. The big problem for the police is that that would be breaking the Law if they tried to enforce a 'guideline', because police can only legally enforce Criminal Law.

If the police detain you, or arrest you because, naturally, you have refused to cooperate, they are then guilty of unlawful detention, which comes under the criminal code of 'kidnapping'.
If they try to fine you, without first 'kidnapping' you, you are not obliged to give them any information, not even your name, and without your name they cannot issue a fine.

If they find out your name, by whatever means and then issue a fine, you can simply state that you refuse to accept or pay any fine and they will then be obliged to caution you, which would be totally illegal since you will not have committed any crime (guidelines being optional to follow) and again, they would not be enforcing any law.

Know the difference: Guidelines come under 'civil law' and crimes come under 'criminal law'. The police are not allowed to enforce 'civil law' - only the local authority and the civil courts can attempt to do that. So, demand that the Court issue you with a date for an appearance, and when/if you go to court your defence will be illegal detention and kidnapping, and in the civil court you will be able to demand substantial compensation as a counter-claim from the police, plus insist that criminal charges are brought against the arresting and detaining officers.

Now, nobody says that it will get to that stage, indeed it would be very unlikely to, but can you imagine how the Courts will be clogged up for years, perhaps decades, trying to process those bloody awkward b*stards who had the bald-faced cheek to know the Law and also know their civil rights.

PS: Ensure you use your phone and record the whole even, to be used as leverage and evidence. But just remember this one fact - the police cannot enforce civil Law and therefore have no rights in determining whether or not you have to wear a mask, just because the government says so. That process would be called a 'dictatorship' and we are not quite there yet, despite this government's valiant attempts to make it so.

In addition it may be a good idea to also print off and hand this to whoever is
telling you that you must wear a mask. I should imagine supermarkets will have
placed someone at the door to check mask wearing. I suggest you just hand
them this and walk in.

1. You have informed me that I am obligated to wear a mask or a device which
covers my nose and or my mouth.
2. I am now making you aware of the medical conditions known as Hypercapnia
and Hypoxia both of which can be fatal.
3. The wearing of masks and face coverings can cause both of the above conditions
due to Oxygen depravation and or excessive intake of Carbon Dioxide.
4. Should you now continue with your demand, you will now become personally
liable for any and all harm I may suffer,along with your employer and whoever
instructed you to enforce those instructions.

OK I don't know if this would work?

what about adding seeking damages or prosecute all in connection through joint enterprise for liability? just a thought.

So the government have determined we have to wear masks in supermarkets but not in offices... Go figure... It is 100% clear that the government is no longer following (legitimate) medical advice. More 'evidence' that the end game is not the health and well being of its citizens...

Probably going down a COVID pass road here but face mask exemption cards are available on ebay for a few quid - search such as 'face mask exemption card', or even make your own, also available here at these disability sites.

Dear Sir or madam

You are refusung me entry to these premises to do my shopping and claiming I have to wear a face covering, this is a policy and not law, this policy is that of your employers and is enforced only upon those employees who consent to it.

It does not extend to me or any other shoppers as I am not employed by your company, or bound by your policies.

Are you aware that I may have breathing or other difficulties such as Hypercapnia or similar conditions in which wearing any form of mask may lead me to pass out and with a high risk of death.
If you refuse me entry and claim I have no such condition then are you medically qualified and which medical body are you registered with and what is your registration number.

You may call the Police and as they have publicly stated, they cannot enforce these guidelines, and as I am not obliged to give them any details I will refuse to do so as this is defined as a CIVIL MATTER and NOT a CRIMINAL MATTER and the Police can only deal with criminal matters and NOT civil matters.

Should I be detained by the Police or any shop staff it will be an UNLAWFUL DETENTION as no criminal offences have been committed and this is defined in law, and this is under both legal and lawful, and numerous lawful precedents exist to confirm this. You could also be breaching numerous Disability Discrimination legislation and this is also a criminal offence.

You will personally be liable for any actions you take on behalf of your employer under "VICARIOUS LIABILITY" and in simple terms this means if you are instructed to undertake any tasks which may constitute a civil or criminal offence; or is unethical you can and should legally refuse to undertake them. If you do undertake them you become equally liable and complicit in criminal offences and both you and your employer can be dealt with under criminal law and civil law, and this will be by civil tort and potentially you could lose your home, vehicles, and any savings you have.
This means that both yourself and your employers will become legally and lawfully liable and any members of a management structure who issued you to enforce a policy which does not apply to me or any other customer.

When we arrive at next week in certain shops ,some people who are wearing masks will probs start acting like vigilante`s and provoke "normal" people into possible violence or maybe even attack normal people which may lead to the coppers having  legit reasons to get involved and guess who`d be to blame,so like Lennon Honor says don`t get emotionally involved in an argument just spell out your rights in a calm manner as stated above and that will be enough to win the "debate" and like Caroline says keep your camera`s on the ready.

I’ve already kicked off at someone who made comment as I walked the ‘wrong way’ round a shopping mall one way system (outside with both lanes at least 4m wide...). He said “wrong way” so I said, jokingly, “Boris said use your common sense” and he still moaned as he wandered off into the distance, at which point I called out “you’re a lemming”...

i don`t have a brian lol. i`m just having a debate with someone and i just want to clear something up so if someone could help me out please ,when all the shops which were closed in lockdown ,were they closed because of guidlines or legislation and if it was legislation could shop owners have opened under common law juridstiction or was there some martial law happening at the time which out ranked everything ,thanks

I recently listened to Mark Windows & Sandy who appears on there sometimes said a friend of hers had to wear one at the airport but on boarding the plane & sat directly next to someone they did not have to wear a mask.

However the public transport which a plane is the legislation is the same as buses/trains to my knowledge an the same exemption applies, international (is that even happening) I could not say about but domestic flights would be as above.

The pilot or security staff can stop you borading a plane for ANY reason, it is mainly drunks who are known about but a captain can stop you boarding for a breach of the airlines policies or guidelines and the service company providing the various services such boarding staff can also recommend that you are not to board and the captain always heeds their recommendations.
