SAR request denied

I have sent a SAR to OC, they have quickly responded that they are unable to complete my request until I telephone them to confirm my identity. I assume this a trap?

They must provide it ,end of.
I presume you provided your name and address, & made the request
by post.

Write back (recorded delivery) inform them that unless they comply
with your lawfull request ,you will make a complaint to the ICO .
Remember to tell them they have 1 month to comply starting from the
date of your original request.
Only ever communicate via Royal Mail.
Also was this the address they have been using in the past to contact you.
If not give them your previous address they hold.

Thanks Dave will try that. Yes the address they have is the correct one that they have contacted me at previously. My request was made via post.

also as I take it you have been communicating with you for sometime? Then ask why are they ask for what they do? If they ask for certain ID ask what is it exactly & then state it does not exist, for me that's worked in the past.

Then simply bring a claim against them and put them in debt.

To add to this, the letter states that I have the right to complain to the ICO and gives their details.

You can if you wish add the following to whoever sent you that.

To the man/woman john : Doe ,i have received your claim that i need
to contact you via telephone in order that you will fulfill your lawful
obligation . please comfirm that you take full unlimited personal liability
for that statement.

Does all correspondence need to be signed by authorised agent and representative or just the NOCA/affidavit?

Got SAR docs from OC, which includes signed credit agreement. Do I now jugs ask DP for deed of assignment?

Are you using the NoCA route ?

Its worth checking the copy of the original agreement, is it ALL legible,is it
all contained on a single page ?

It is all legible, in a 4 page format (2 x double sided).

I was planning on starting the 3 letter process to the DP.

Thanks. I've started the NoCA process. After 3 weeks of continuous phone calls and voicemails, the first notice must have been read as the all telephone contact has now stopped. 1 nil to me.

I have received a response back from first NoCA, which is (obviously) not from the person i addressed it to (CEO). It appears to be a standard template like response which ironically refers to my notice as a template letter sourced from a ‘debt free’ website. It is even has a paragraph that says they ‘reject my fee schedule’ - no mention of fee schedule in my notice.

I will continue the process and send NoCA 2 to the CEO, but should I respond to this garbage separately?

Yep thats par for the course. Just rebut their presumptions and
keep all the BS seperate. It does not form part of the private correspondence
and should be treated as a 'non response'

I would write to the CEO again and add that he/she has allowed another to trespass in your private business affairs and this alone is a common law offence, or just make mention (and an issue) of it so he/she can see you are no idiot.

How long does it usually take for the royal mail tracking service to update the status? The notice i sent around 3 weeks ago has definitely been delivered but just showing as 'accepted at post offce'.

I am keen to send notice 2, can i just state the date sent and tracking number?

I get that sometimes. Its still proof you sent it, yes state date and
tracking no and get the next notice sent.
Leave it a couple of weeks and claim from RM (you paid for signed for)
and did not get that ,they usually send you 6 1st class stamps.

Proof of posting is also proof of delivery and that is the law, if they are claiming NOT to have received it then it is up to them to prove it.

just had a quick read and it seems we are on track in general but....

the OP just mentions that they have received the 'agreement' 4 pages of it.

1) does it contain all terms and conditions and your right to cancel ? what year was the agreement started ?
2) does the Sar contain a default notice ?
3) does the Sar contain a written notice of assignment ?
4) does the Sar contain a termination notice ?
5) does the Sar contain statements of the account going back to the date of inception to the date of sale ?
6) does the Sar contain any Deed of assignment ? as that should contain your account data ?

now is the time to study the Sar and what the DP needs to enforce any 'debt'
