Due Diligence : if when receiving a "bill" for "money" then carry out your own (in the name of the MAN/WOMAN), ask/DEMAND to see the monies are actually owed, possibly through forensic accounting practices.

Hi LL. I watched the last vid and i would like your take on my question. I am from australia and what would happen if the Bank never sent you to see the ombudsman to settle the dispute you had with the Bank and the Bank sold the disputted account to a debt purchaser Without it been settled?

To answer your question I am not familiar with Aussie statutes & acts so I can't really answer. However in the UK we have something called the Bills Of Exchange Act 1882 - there possibly is an Australian equivilant - if you check out section 59 of that act it may give you some idea of how to counter your situation - look at sub section 3

In short if its been bought by a DCA, then thats it - its PAID!

subsections 1, 3 are what you possibly need.

59 Payment in due course.

(1)A bill is discharged by payment in due course by or on behalf of the drawee or acceptor.

“Payment in due course” means payment made at or after the maturity of the bill to the holder thereof in good faith and without notice that his title to the bill is defective.

(3)Where an accommodation bill is paid in due course by the party accommodated the bill is discharged.
