Hi Guys,

Im at the stage of the goodf process where I am due to issue a bill cover letter and invoice to first direct.

Initially I did not realise they had put a negative entry on my credit file.

I have had no contact from first direct since the estoppel notice. No calls. No emails even advising that they are chasing a debt.

Do I hold out now and continue to issue invoices or should I be worried about potential court action etc.

It doesn't even seem like they have gone through a collections process or attempted to as a duty of care. Is that legal?

Do I sit tight or should I be doing something different.

Any advise would be much appreciated.

For your 3 threads , read, research & when you comprehend. adapt these
notices of Condition Acceptance.
Only use these when you have done your research ,links are provided.
Personally i would recommend you purchase the e book The debt bomb,
from Obversation Deck on youtube he uses the same approach .

Please do not cut and paste ,it shows the other side you dont know what
you are doing and are just pushing your luck.

Hi daveiron,

thank you for your reply.

I posted x3 seperate threads as was instructed to previously to deal/get advice with each individual creditor.

I watched the observation deck video previous to sending the conditional acceptance but admittedly used the template from the ebook downloaded from this forum rather than the questions from the observation deck video on youtube.

I also purchased a book called behind the curtain and have tried to educate myself as much as possible.

I suppose its reassurances Im after - as although I believe that I have followed the correct process with the banks and asked the correct questions/ letters sent and bespoke in their nature - they have literally now refused to address any of them.

In MBNA's example I have it in writing on x2 occasions that they will not inter in to discussion about it - which I find blatant ignorance which surely cant be in their favour?🙈

my questions are moreso:
- can these banks still enter negative creidt file entries
- can they still prompt me to try and contact them even though they themselves seem to have taken heed not to call me directly from the letters?
- do the letters ive sent give any form of protection to me should legla proceedings commence.
- can i request for negative credit file entries to be removed based on neither bank sending any proof of accounting or debt regardless of my requests.
- These banks have not rebutted my claims, i.e not addressed all points as i requested. they try to dismiss my letters as complaints even though i explicitly state in RED writing that they are not complaints.

Sorry for the essay but I hope you get my jist 😅 for example - MBNA and paypal sent a bundle of information as if I had requested a SDA - which I had not. surely this cannot constitute to a rebutt of my claims?

Sorry i have no experiance of credit reference agencies.
As all your alleged debts are still with the OCs ,and they are not threatening
action ,i think all you need to do is withdraw you permission to be contacted
other than by Royal Mail.
Dont know if you have noticed but the NoCA section has now been completed
it also shows a rebuttal you should send when they try to claim you are making
a complaint. ( remember anything unrebutted stands at law).
Dont rush things its always easier when they have sold off any alleged debt
Make sure you keep all the correspondence you have so far,because it will
show you have been repeatedly trying to resolve things with them.

Overall I agree with DaveIron. Wait they sell on (which they will…)

Also yes, the can add entries to your credit report as they are allowed to. And any defaults will stay on your file for 6 years (England and Wales) or 5 years (Scotland).

please could someone send the link to the NoCA section and the rebuttal template. I cant seem to navigate/find it so far.

Thanks again for all your help - I think I will sit tight but I definitely want to rebutt any claims that my letters are a complaint - and also request all communication in writing.

I honestly think you’re wasting your time when it comes to fighting the banks, hence sit tight until they sell on.

Also, once they sell on, it’s easier to fight the debt purchasers as you’ll see in time…

(Been there / done that / written off almost £20K in alleged debts…)
