Lowells letters & Txts?

Hi all, I have been getting weekly txts and letters from Lowells for the past 18 months which I just ignore as i have no dealings with the bottom feeders.
This all stems from an unpaid gas bill on a property i sold in 2019, where for many years I did the giro credit slip return...but they keep chasing. I would just keep ignoring them but my issue is they have been sending these letters to my Elderly Mums residence, any ideas or tips on how i can put an end to this? They have no idea where i reside anymore and id like to keep it that way.

When I was dealing with this scum I hand wrote narrative on paper & photo copied it. Every time they sent a demand for money I would always put a copy in the same sent envelope & sent it back. After several months they finally admitted they didn't have the info I was demanding, so I replied thanks for admitting you don't have a claim, not heard a peep since, that's a good 18 months back.

For the letters to your mums address, a Cease and Desist Notice
has worked every time for me.

Many Thanks, are there any cease and desist templates about? or just something to the effect you claim i owe xxx and that i have no knowledge of said debt & will take action under section 1. of The Protection From Harassment Act
1997. as the continuous letters are causing distress... in my mothers name i presume? send it to the CEO (John Pears?) also is this the best address Ellington house 9 savannah way, leeds, LS10 1AB

Personally i prefer to deal with it ,rather than ignore and hope they go away.
On e problem with ignoring it is it leaves them an open door to bring a cc claim
if they dont have your address and get a default judgment.
Do you know if they own the alleged debt ?

Just a simple letter headed Notice to Cease and Desist.

informing them they only have your permission to contact you via Royal Mail.
you will of course need to put your address on it or c/o your mums address

Yes you have the right address for them and you can add what you have put
in your post.

I will put up a general template for a C&D notice this week.

Thanks again. I haven't lived at that address for over 30 years. Should i just get my Mum to say she doesn't know where i am and to stop hassling her with all these letters? they cannot transfer the debt onto her surely?

No any debt stays with the debtor only ,unless someone acted as gaurantor
or account was in joint names.

are lowell acting on behalf of the provider or have they bought the account ?

Hi waylander yes just found out they bought the debt, im not at the address they send them to (not since 1991 lol)so can only find out letter details over the phone from my parent.
Would like to stop all this as they keep sending letters to my Mums address which gets her worried

the only way i can see to stop the letters going to your mums is to send a simple letter from your mums address but obviously not from you yourself informing them you DO NOT live at this address and have NOT lived at this address since 1991.

however i must add that lowell are notorious for then issuing claims and getting default judgments at known wrong addresses so stay alert once they have been informed that you do not live at the address.

RE: Cease and Desist From Harassment.

The CEASE AND DESIST ORDER is to inform you that your constant flow of letters to my address have become unbearable. You are ordered to stop these actions immediately. Mr xxxxxx does not reside at this address and has not done so since.

I have the right to remain free from these activities as they constitute harassment and I will pursue any legal remedies available to me against you if these activities continue. Please see The Protection From Harassment Act 1997 section 1.

You must IMMEDIATELY STOP the letters and send me written confirmation that you will stop. This letter constitutes your final warning to discontinue unwanted contact before I pursue legal actions against you.

had another from lowells dated the 9th of September ...so they took no notice of the cease and desist order i sent signed for, any ideas what else i can do?

Try a complaint to the ICO ,they are sending personal data to an address
where the data subject does not live ,thus passing personal data to third parties
and have been informed so on many occasions.

Submit a claim against them in the County Court and you can use the Virgin case as a precedent and when it begins costing them money they will cease.

There is a key point implied by Assassin’s post. Ultimately, like almost everything else, it boils down to money. They will not spend more than the value of the alleged debt in their admin costs in chasing payment. In fact, they’ll stop long before that, because when they bought the alleged debt, they paid pennies in the pound compared to the alleged value… Wink
