Some times if time is of the essence I will email them and put
*letter to the same effect has also been sent , *
You can also pay around £8 for special next morning signed for delivery ,

Yes which means send a letter off at the same time... ..
I.E the email is instant and logged at least if time is of the essence ...

I told you to print 2 copies and send a letter to the same effect but tell them this in the email ,
You had run out of time as you where not coming back to the forum frequently ,
At least an email would be logged while your special delivery letter was in transit ,
I think that was quite clear ,
When I needed help from these guys I was literally sat refreshing the page ,
If you can not do this so you can act with the sense of urgency needed then install the app which will alert you to topic responses ,
People are here to help but you have to help yourself ,

Hello,
I have had three letters dropped through my letterbox by my nextdoor neighbour which were delivered in error to his address.He has been working abroad this past month and has only just returned.One is from Overdales dated 5th of May in response to my last communication to them in April !
First page ; "We refer to your letter of 12th April 2023 .We regard this as your response to the pre-action letter of claimissued to you.We are currently mamging an account on behalf our cllient Lowell Portfolio Ltd"
They then state reference number etc with name of original creditor and date of last payment received by original creditor.
"A copy of the credit agreement and statement have been enclosed.Should you wish to dispute this matter you should seek legal advice ofrom a solicitor or citizens advice"
It then asks to contact them within 30 days to discuss a payment plan.
"If you do not contact us within 30 days to agree a resolution we may request that the court issues a county court claim to you."
They have enclosed a credit agreement with the original creditor which has my details printed on it.At the bottom of the agreement it states "This is a credit agreement regulated by the consumer credit act 1974.Sign only if you want to be legally bound by its terms"
Under which they have printed my name by 'Signature' and printed the date of signature.
Finally they have also enclosed what looks like a fascimile of account summary statement from original creditor listing transactions.The reverse side of this has printed in bottom corner "Direct Adequate Explanation v6 .
Any advice would be appreciated.

So I may be wrong but did you receive the paperwork outside 14 days of your CCA request ?
If so then it is unenforceable ?
I'm sure someone will correct me if wrong

If the required documents aren't provided with the required time, it's unenforceable until they are provided. Not unenforceable forever. CCA 78 (1) and (6) (a)

The three letter method does work. It worked for me for multiple OCs, DPs and DCAs (inc in-house solicitors acting as DCA). And I wrote off combined alleged debts of approx 20K… You have to apply the method correctly.

You could try and print out every email and send it as a letter

Hello all thanks for all the help.
I now have notice of county court claim letter giving 30 days notice.Despite 3 letter process i am awaiting bailiffs.Guess things not worked as planned.i will try uploading latest letter.

No luck uploading copy of letter.basically overdales repeating process of 30 day warning to instruct bailiffs and asking for plans to make payments or else.

why cant you upload the letter? If it is too big you can crop the image as small as possible or resize it in paint or any photo editing software or you can make an account here ....https://servimg.com/ and use the hosting service .

And before you (Raymondo) upload any letters:

PERSONAL INFORMATION and related:
Never provide personal information in your posts (including letters you upload) to this site i.e. your name, address, bank details or even reference numbers that you receive in your letters (also check out for barcodes / references sometimes written vertically on the edges of letters…). And if you upload letters, mask the dates too.

Do not even state the EXACT amount of the alleged debt. Round up to the nearest £100.

All of this type of data can uniquely identify you and therefore risk your anonymity. Trolls (debt collection companies, solicitors etc) are known to roam these forums and hence why your anonymity is important...

If he is struggling to upload could he send it to a trusted admin to upload on his behalf ?
It can be tricky if you're not I.T minded ..
I know personally Ive managed to upload the same photo several times over without realising it ..

Looking back a bit, on 5th May they were still threatening court action ..

So 30 days would take you to the 4th June. It seems a bit quick to have already reached the CCJ and bailiff stage, not to mention you should have received a couple of items from the court. Are you sure the "letter" wasn't indicating that they are starting proceedings, with something along the lines of "this may lead to judgement bailiffs blah blah.

If you can't upload can you confirm firstly who the letter was from (solicitor, creditor, court etc) and type the contents with personal stuff o fitted?
