Lowell vanquis - Tiggy?

Hi i sent the 1st leter and had a response from them after a few days saying they would get the information to say that i owe the money to vanquis now months later they have responded with the info of the account... i was speaking to tiggy on another well know forum that has now turned of there login ! what would be my next step now they have sent the info regarding the account as its been well over 12 days as stated in my 1st letter if you are around tiggy any help would be much apreciated thanks in advance

Hi & welcome,

Please take the time and do a little reading on these forums so that you have a better understanding of the process.

You should have sent the letters 10 days apart . (Do not let them dictate the timescale)
Did they send all of what you asked for ? If no ,then complete the 3 letter process.
I would guess they only sent a poor photo copy & statements .That is not what you asked for.

What have they sent you and what are they now threatening?

How long ago did you default / did they send you a default notice ?

hi guys thanks for the replys and hello tiggy Smile

they have sent me the copys of the statements and a copy of digita signiture aplication details from vanquis this is from 2010 and that i should now contact lowell with a repayment plan within 30 days from the 4th of this month or they will send it to county court menny thanks again guys

I would carry on with the process, what they sent you is obviously not what you asked for so you should not accept it

hi i have had a response from them on the second letter saying that they have already enclosed a copy of the agreement and statement and they have included them again in this recent letter also giving me 14 days to contact them for repayment or will send it to county court

what should i do now should i just send the 3rd letter

any help would be much apreciated thank you

Hi L8Z

yes send 3rd letter

when was last payment and when was the default notice sent, if if over 6 years it may be statute barred,
if they sent you a copy of a agreement then it must be a true copy , look on my post court , there is a copy of agreement that failed in court , we need a bit more information .

hi thanks for reply.. the last sucsesfull payment was on 17/11/2011 and at the end of the statement it says "final charge off" thats dated 3/6/2015 im not sure when the defualt notice was sent to me as i have changed address over the years. would it be easier for you to see copys of what i have got somehow? thank you

yes if you can send , so we can see what they have sent you that would be great ,
( but remove your details)
dont worry of dates they may of charge you,
also send next letter after 10 days if you have not done so.

Hi L8Z

Your last payment was on the 17/11/2011 if they sent you a default notice this would be after this date, and say if it was 6 months from 17/11/2011 it will still not be stated barred ,

can you show us the the agreement,

but you still want to see the default notice , and the other paper work,

send one more letter ,

i require copy of the default notice also the other information requested, if it proceeds to court i will apply for a unless order form n244 , to force your client to produce the evidence ,
i have stated on ( - ) occasions that i will pay on proof of there legal ownership of the alleged debt ,

1/ was it sold in accordance (the consumer credit Act 1974)
2/ proof they legally own the alleged debt

however

and i have made every effort to settle this situation , and that i will deem it as a vindictive act if it proceeds to court, and i will defend against any solicitor and court cost and the claim itself.

I trust this clarifies my position

this what i would do , think what is best for you

Not unless it has all the required terms and conditions attached, then no it's not even close.

No this is not the agreement , what is on page 1 or 3 also did they give you a credit card when you was not in employment ,

sorry this is page one to that and as said before they only sent statements along with this as requested from the first letter of the 3 letter process

NO you just have to wait,

give it another 3 or 4 weeks and let us know , maybe they just looking for the paperwork or they may of give up we just dont know yet

we thought they said in 14 days they send to court , we also thought they had the documents lets see what they do if they send any more paperwork , sorry but we just have to keep waiting but so far its looking good Very Happy

I had the same thing come through when they updated the rules in October. I asked for a copy of the agreement and statements, to which they replied.

Lowell vanquis - Tiggy? Lowell11

Anybody know if this is the case? They haven't sent me the terms and conditions, so should I ask for them again? Seeing as it was part of the pre-action protocol letter. I have completed their paperwork and sent back, along with the CCA request and CPR 18 request. They have sent me the same application form as above, now I have the default notice too.
