Hi Everyone

Please can you help

I have sent 3 letters to Halifax and estoppel and they still are sending letters that I have to pay the balance owing on the account.

Is there a letter I can send back or do I just ignore what they send?

As long as they are just asking for money, that's good. You can ignore them while they're sending repeat letters just asking for money.

Rather than ignoring them you could send them something like this

In reply to your letter dated (most recent letter date) the contents of which are noted and rebutted in their entirety

Firstly let me remind you that you were given a chance 3 times to prove your claim by sending me the following items and failed to do so

1. Validation of the debt (the actual accounting); You did NOT send me this
2. Verification of your claim against me (a sworn affidavit or a hand signed invoice in accordance with The Bills of Exchange Act (1882) ); You did NOT send me this either
3. A copy of the contract signed by both parties and therefore binding both parties. You did not send this either
4. A true and certified copy (NOT photocopy) of the Original Note (Credit Agreement), under penalty of perjury and with unlimited liability and confirmation that this Note, has never been sold. You also failed to send me this.

5. The name of the individual who is the duly authorised representative from your company, who has carried out due diligence under The Money Laundering Regulations 2007 and what actions s/he has taken in relation to this account. You also failed to send this

AS I SAID BEFORE FOR AVOIDANCE OF ANY DOUBT NOTHING ELSE OTHER THAN THE ABOVE WILL BE ACCEPTED


In addition to the above I now also ask you for the following 2 items
1. A signed statement from a named individual from Halifax ,that the original agreement has never been sold or traded in any way.

2. A signed statement from a named individual from Halifax that no insurance claim has been made in respect of this claim.

These are in addition to the documentation requested that you have failed to so far provide.All including the original agreement will be required in court should you decide to proceed.

As I have already told you as you failed to supply me with any of the above mentioned documents as a result I DO NOT accept that there is any outstanding balance and I will CERTAINLY NOT be paying you anything. I still DO NOT acknowledge any debt to your company and will NOT be paying you anything unless of course you happen to send me all of the documents I have requested
