What can ai do about Santander

Hi everyone
my daughter had a loan from santander of which I was guarantor, my daughter stopped paying the loan and I was taken to court 13 years ago and have been making monthly payments by direct debit ever since never missed one payment. Today I have received a letter from them saying I am in arrears and instalment agreement will be terminated if not bought up to date my bank has paid every instalment every month without fail. What I want to know is what am I entitled to see regarding the loan agreement I really want to stop paying these bxxxxxxs can they take me back to court after all this time. The law firm they are using is DWF LAW LLP

If it were me i would use the NoCA for original creditor.
Just say you have been doing research into banking.

I have succesfully used them with Santander.
I would urge you to do research as that 'loan' document your daughter
submitted was in fact a prom note and treated as cash by the bank.

Addition; thought i recognised DWF LAW .I beat them before court last year
when i bought a case against a major retailer over mask wearing.

I would think it should be from you, as gaurantor are the one liable.

OK Daveiron I will watch this tonight and decide and send it off tomorrow thank you once again for all your help and advice, their is one thing I havnt stopped paying them so what can they do, its just a request. thanks again

I would just stress, at the bottom of the first link are a lot of links,
mostly vids ,please study them so you fully comprehend how the system
works,its ok to send notice 1 and then study.

Just one other thing, avoid giving DWF your email address or they will try to
do everything via email,thats a problem i had with them.

Thanks Daveiron I will take my time and take allot of care with this I didn't mind the monthly payment it came out the bank I didn't miss it but its not the first time dwf have threatened me saying I was in arrears when not so it's santanders law firm to blame thanks again for help will keep you informed

Had reply plus unsigned agreement from santander solicitors, second notice has been sent out to them all help welcome thanks

As a start, if your original notices were sent to Santander Bank and not
Santander Consumer finance ,start the notices again to SCF ,send the first one
give them 3 working days for the CEO to respond after reciept,
then repeat with notice 2 and continue the same way until you have
completed the process. You need to get them in the tacit agreement asap.

If you want to have some fun with DWF inform them you decline their offer to
contract .
You could also ask for the name of who is stating that any loan agreement is
not a promissory note. Thank them for admitting that the claimant does not
hold the said agreement, and how would it be possible for you to redeem the
note to cancel it if the claimant does not have it.
