DWP and HMRC alleged debts
Hi there,
I had huge success with 3 letters and GOODF process a few years ago (I have a thread in the success stories but dont want to link the usernames at the moment) and am in a position now to fight some more financial claims on me, starring with the biggy...
I have two debts with the HMRC which are currently under an arrangement but I now feel mentally ready to fight back.
Two over payments, one of 4k and one of 9k! I couldn't tell you what the 4k is for and if it's possibly the same year as the 9k (one maybe being child tax credits and the other working tax creds).
Both are with DCA's which I know I could fight off with the 3 letters but what would be the benefit between paying them or paying HMRC directly?! And if I have it returned to HMRC, wouldn't this just provoke them into seeking CCJ etc?
I have evidence of a mental health condition which I can use for extra time to deal with debts due to vulnerability but again not sure how I can best use it in this instance.
I think my first step is to do a SAR. It will be tricky because the year that the over payment refers to is when I was freelance and though I originally had low earnings with 1 or 2 day bookings, by the end of the tax year I was working full time and my earnings pushed me over the threshold. I don't remember all of the details but I think because of this, they claimed the whole year of payments back, so any guidance around this would be useful too please.
I'm pretty self sufficient, if you can give me some pointers or a list for the process I could follow I can find the rest of the information and templates etc.

Personally i would start with a letter containing a DSAR and ask for full details of their over payment allegation,including but not limited to the names of who is making the claim.
I would also ensure that whoever responds is the one you address everything to in the future (their favorite trick is to send replies form as many different people as possible)
You need to make it personal ,dont let them hide in their corporation. Once you get all the info you can start to question them on a personal level,ensuring they hold liability
for their answers .

Never forget the DWP and HMRC are corporations and both dead entities and only a person can make a claim so get the names of the PERSONS actually making the claim amd always ensure any documentation is signed with this name, if you get an unsigned or letter signed DWP or similar this is instantly a breach of Commercial Law maxim 4 which deems it as being incomplete and having no voracity. If it is unsigned it also means nobody is accepting liability for the claim.
