In my last post, you may know I'm unemployed and renting.

I've had a few people chasing me who have sent a document requesting financial incomings and outgoings. Most recently HSBC's internal litigation dept who are threatening court action.

Is it worth showing how skint I am in an effort to halt them from court action or it is a sign of weakness and better not to engage?

I've done the 3 letters.

DCA ,s would not care if you are skint or if you have no food on your table for your family, they want your money full stop ,

I would never show any DCA weakness or they will never give up

This isn't a dca that's chasing you it's the Litigation Department of the Original Creditor. HSBC mostly don't sell on debts and usually have the paperwork needed to win in Court.

Along with currently being in severe financial difficulty, have you considered whether or not they, given your financial circumstances at the time, should have extended you the credit they did, or do you possibly have a case for irresponsible lending.

Also, if they have nothing to gain from you would it be worthwhile taking you to Court, they may or may not decide it's not worth their while, hard to predict.

I'm not sure I'd have a case for irresponsible lending as my financial situation was strong at the time, but worth considering.

So, when you say if they have nothing to gain from you, do you mean I should return the money in/out form?

with HSBC , i still would not engage

maybe you was in a good job when you got a loan from HSBC

Did they send you a default notice  with the correct information on it,

Have they got the agreement or true copy

If it went to court and you lost , the court will look at your income and outgoings
but also read tiggy post and think

All their paperwork seems in order. Unfortunately!

There may be a job on the horizon after Xmas, hence my interest in disclosing my poverty now :-)

Hi spike,

The 3 letters are designed specifically for whoever is chasing you .

So if HSBC do not sell on the alleged debt, then you will not need the letters for debt purchasers.

I think he means, why am I still being pursued by HSBC after I've sent the 3 letters.
