Is it proof..

Hi,

I sent a first of three letters to a company asking for money. They are not the original people i had a credit card with as the Bank sold it to them. They have supplied me with a copy of the original agreement i had back in 1994.

Do i just send letter 2 now or what really.

Many thanks for any assistance.

Hi Phil,

A little more info please ,ie; Who has purchased the alleged debt ?

When did you get the default notice ? ,is amount under 10K ?
Which letter did you send ?
Was the copy of the original agreement a 'true' copy or just a poor photocopy?

we need a bit more information,
how old is the alleged debt from the default notice

Hi,

I attached scan of sgreement below, it wasn't a great photo copy they sent me. I defaulted back in 2012, and the amount is just over 3k.

PRA Group Bromley are the ones requesting the money as Lloyds had confirmed they had sold the debt to them.

petesomething when we apply for a credit card by the Bank that the Agreement is signed by us and the Bank correct?

Hi termi2607. What you have is only your Application to Lloyds Bank applying for one of their credit cards. It is not an Agreement/Contract as what is the name of the Bank representative that has authorized the card? If you look below where you had placed your signature and date that below is seperated for Lloyds Bank ??? Card Services Signature. No one is a witness to anything as to me it is only an Application only and not an Agreement. On the old site faljay had said that an Application is not the Agreement as it is only one sided. Wait for those that know more to post and they should tell you to send letter 2. Read that Application carefully as the dca chasing you have no Agreement as it is clearly an Application. Ask the others if you need to add in the next letter that they have not provided you with any Agreement and the Application is a different species.

The agreement does not need a signature from the bank a bank stamp will do, however on my computer i cant read this agreement , it does not look like a true copy,

have you sent all 3 letters now, any more replies

Hi petesomething. Sorry if i am wrong as i thought that the Agreement would have what the limit of the card is and where is the APR?. From the old site i had thought that faljay had explained the difference between an Application and an Agreement. So i thought that since it clearly said Application that it was only an Application and not an Agreement. I do not mind been corrected so as i do not make the mistake twice.

It's not a good copy, but i will see if i can make the image larger and better to read. I have sent the first letter but no others yet. They sent one reply with copy Agreement/Application. Nothing else as yet.

carry on with the letters 10 days apart, dont let them dictate the timescale.

They are making the claim and as such they should have all the information to hand.

you need to keep sending letters 10 days apart , have you got the default notice ,if so check all information is correct .
